According to Commercial Paper Law the money was now legally mine, he said, "The way a bank invalidates a check is by serving the depositor with a timely notice of dishonor. They've only got 48 hours to tell you -- from when they found out — not from when you deposited it. You say it they told you 33 days after your deposit so that suggests they blew it. But we'd need some proof. And then again, maybe they did tell you within the 48 hours. We don't have a way of knowing either way."

Q: Who has responsibility for ADA compliance in leased places of public accommodation, the landlord or the tenant?

Are you tired of all those telemarketing calls you get during dinner? You might be surprised to learn that your phone company
might be behind some of those calls.

Qwest routinely gives your personal information -- name, phone number, calling habits and Internet choices -- to its companion
companies, but you can put a stop to it.

You might not know her name, but Phyllis Rowe has been fighting for the rights of Arizona consumers for 20 years. She's the
president of the Arizona Consumer's Council and she's not very happy with Qwest right now. A little announcement in this
month's phone bill is to blame.

"They place it in the middle of the small print," Rowe said. "People don't read things any more. They don't read where there's
lots of stuff to be read. They just throw it away."

Qwest intends to make you personal information public to telemarketers. The annoying calls at bad times seem to be nonstop
and they're about to get worse.

"It's just not fair," said Rowe. "It's a violation of our property."

From Qwest's corporate offices in Denver, a spokesman told 3 on Your Side the company respects the privacy of its
customers and will only share account information with its own internal divisions like Qwest Wireless, Qwest Dex Information
and local and long-distance services.

After a bit of pressing, the spokesperson acknowledged that Qwest also will be giving your personal information and calling
patterns to outside long distance carriers and Internet providers.

In a written statement, Qwest says, "We sent out the bill insert so customers understand Qwest's privacy policy and the
circumstances under which Qwest intends to share customer information."

They also say the pamphlet tells customers how to keep their information private. All it takes is a "simple" phone call.

"I dialed it several times yesterday," said Rowe, "and I got either a busy signal or it rang and rang and rang and then I was
switched to the operator."

Rowe's phone has been ringing off the hook with calls from frustrated consumers looking for a way to stop the flow of
information.

"We are concerned and hope that more consumers will scream about it," she told one caller.

Rowe was finally able to get through to Qwest and remove her name from the list -- it took three days of trying.

The phone number to call to opt out of the information sharing is 1-877-628-3732. You can also do it via the Internet. The
Web address is www.qwest.com/cpni.

The deadline is Feb. 1, 2002.

Update: We were overwhelmed with calls and e-mails after telling you about
Qwest's plans to share your personal information with other companies for
telemarketing purposes. Apparently the Arizona Corporation Commission was, too.

The commission wants some answers and has scheduled a public hearing for
Wednesday, Jan. 16, 10 a.m., at their downtown Phoenix headquarters (1200 W.
Washington St.). Everyone is welcome.
