Clandestine meetings? I think you might be watching to much TV.

Meeting with the board took a lot of preparation. Hard work. A team effort.

I have met with many open minded neighbors for the first time over the past couple weeks. Many positive suggestions came out of these meetings. These adults I met with understand that after 15 years, daddy developer, really is not such a good daddy.

By the way, the last time I had to get approval from anyone on anything I was 17. Will, your starting to remind me of my mother.

Anyway, chew on this for a while. This is the constructive group effort of about 10 residents. Funny how you've complained about ''trouble'' in the discussion area, but you yourself have yet to be constructive.

To the Directors/Officers of the Circle C Ranch Homeowners Association:

We the undersigned request the Board accomplish the following prior to the Annual Meeting to be held on March 26, 2003:

1. Make a commitment to make every effort to reduce or eliminate the
increases in the annual assessments in the future by studying and adopting
new ways to raise the necessary funds for HOA activities.

2. Require, encourage and sponsor sealed bidding for selected services and
properties acquired by the CCHOA. Recognize that there are costs associated with competitive bids including preparation of Terms and Conditions, proposed Contracts, selection of Qualified Bidders, reference checking, Legal Counsel and that such bids should be preceded by an internal cost effectiveness study and opportunity for present providers to improve operations and reduce expenses, as applicable. Under no circumstance shall a provider of services to the CCHOA be affiliated with or related to a director or employee of the CCHOA board, any employee responsible for management of CCHOA, or with any person or entity affiliated with another provider of services to the CCHOA;
however, an exception to this prohibition can be made only if presented to, discussed with and voted on by a majority of a meeting of the residents. At this time, we envision that bids should be obtained for landscaping services, swimming pool maintenance, inspection/review, management, legal and accounting services.

3. Commit to establish an Ad Hoc Internal Operation Audit Committee composed of CCHOA members having related experience and not holding any CCHOA office to methodically review all operations and financials of the CCHOA with the objective of finding ways to reduce cost and to reduce any exposure to losses, waste, or abuse. This committee will coordinate with the CPA doing the financial audit to ensure all relevant areas of operations are surveyed and reported upon over a 12 month cycle. The Committee shall be voted on no later than at the next homeowners?’ meeting.

4. Establish a central location in which CCHOA members may view all documents required by By-laws to be open at all times during normal business hours. Promptly create a comprehensive library of these documents for all past
years. Provide a reading table, chairs with full access for all residents.
Establish a program to convert HOA documents to PDF or other readily
accessible files by scanning when necessary or converting from existing file structures on HOA computers when possible and make those documents available online to HOA members. Adopt a policy of complete disclosure of HOA documents to the members and make all documents part of the library, not just selected ones.

5. Include in the Homeowner Document Library a list of CCHOA Directors and
Chairs who are bonded along with the level and cost of said bonds. Also
include a list of insurance coverage and carriers, indemnification agreements
or contingent obligations. Also include complete and current e-mail
addresses for all residents to facilitate communication between residents.

6. Produce an independent CCHOA website that would replace the current
homeowners section, (continue to provide a link) to/from the commercial site
used to sell properties. Create an extensive frequently-asked questions
section and post all committee meeting dates in advance to welcome all
residents.

7. On the website and in newsletters, welcome residents to be part of the
CCHOA committees and provide a welcome response system for those who do ask to be involved.

8. Provide comprehensive biographies and open disclosure regarding any
outside fiduciary or outside business relationships the Directors and
Committee Chairs may have with any business of the CCHOA. Require the same of anyone running for office or volunteering for a Chair. Post these on our new HOA website and in every annual report.

9. Improve the service of the current homeowner information system. Impose a
new strict policy that every question, from every resident must receive a
full courteous answer in a reasonable amount of time.

10. Require that any major changes to the common areas (such as the swimming
pool light and weight system) be submitted to the architectural control

11. As all homeowners pay the same assessment rate, endeavor to create
amenities, such as pocket parks and playscapes, in North Circle C and other
areas that are more distant from the pool and parks enjoyed by more proximate
homeowners.

12. Commit to publish a quarterly status of the adherence of the City of Austin to the terms agreed upon in the Annexation Agreement. Expedite
compliance by the City.

13. Require that all paid or partially paid positions established by the
CCHOA be openly posted for applicants and that all qualified applicants are
considered before such positions are filled.

14. Continue to successfully represent the interests of all homeowners
regarding new roads, new zoning, new construction, City and County services,
AISD, and so forth. Report quarterly or more often as appropriate.

15. Endeavor to fill the Chair position for the Safety Committee and charge
this committee to do its best to help improve internal roadway and pedestrian
safety; more neighborly driving behavior; bicycle safety; ensure rapid fire department, police and sheriff response time; emergency preparedness plan; neighborhood watch.

16. Work together with the City, Parks Dept, Developers, Wildflower Center,
to enhance the hike and bike path system and to obtain Federal Funds. For
example, Georgetown just obtained $1 Million Federal commitment toward an
eight mile path system.

17. Require any landscape service provider to work with the city water
preservation department to reduce the water usage by following a 5 day
watering schedule, watering at night, a water/rain shut off system, and
fixing sprinkler leaks in hours, not days.

18. Ensure that the CCHOA cash account is producing maximum interest, and
that any incentives such as points earned through debits are accumulated as
cash. The account shall be placed in a bank or financial services company
that has no direct relation to any CCHOA board members.

19. Improve the Budget and Financial reporting to give greater visibility to
the following:
Swimming pool operating costs.
Income received from outside swimmers who use the pool.
Income received from Circle C Swimming as operated by Mr. Reese.
P&L statement for the above.
As exact an estimate as possible of cost vs benefits for the above.
Ensure that CCHOA maintains not for profit status.
Comparisons of actual vs budget with reasons for over or under.
Ensure that Circle C Swimming is paying a fair market value rental for the pool.

Good Information

I have heard complaints about the HOA board not communicating information in a timely manner. Why did you not give us some status about the ongoing meetings? We all would be happy to hear about positive progress toward solving the issues that we all agreed need to be addressed. I would think you would have been anxious to post this information.

I don't like the fact that it takes the stick instead of the carrot to get information, but that's the way it is here in Circle C.
