El Cisne Night Club has filed an Appeal to the Permit and License Appeal Board, requesting an exemption from the locational restrictions for a Class A Dance Hall.
Chapter 41A of the Dallas City Code specifies that a person commits an offense if he operates or causes to be operated a dance hall with a late-hours permit within 1,000 feet of:
(1) a boundary of a residential district as defined in Chapter 41A; or
(2) the property line of a lot devoted to a residential use as defined in Chapter 41A, whether such use is within the city limits or not.
The Permit and License Appeal Board may, in its discretion, grant an exemption from the locational restrictions if it makes the following findings:
(1) That the location of the proposed dance hall with a late-hours permit will not have a detrimental effect on nearby properties or be contrary to the public safety or welfare;
(2) That the granting of the exemption will not violate the spirit and intent of the city code;
(3) That the location of the proposed dance hall with a late-hours permit will not downgrade the property values or quality of life in the adjacent areas or encourage the development of urban blight; the location of an additional dance hall with a late-hours permit in the area will not be contrary to any program of neighborhood conservation nor will it interfere with any efforts of urban renewal or restoration; and
(4) That all other applicable provisions of Chapter 41A will be observed.
NOTICE: The Permit and License Appeal Board of the City of Dallas, Texas, will hold a hearing on the above appeal at 9:30 a.m. March 7, 2000, in Room 4CN1 on the fourth floor of the Dallas City Hall which faces Young Street between Akard Street and Ervay Street.
