ANNUAL MEETING
We had a great turnout at the Annual Meeting. Thanks to all took the time to attend and meet their neighbors. This letter is being mailed, along with copies of the President?’s Report and the Treasurer?’s Report which were presented at the annual meeting. You are also being sent a copy of the Resolution, which was passed on January 17, 2003 clarifying who is eligible to run for a Board position.
BOARD MEMBERS
Contact a Board member for the results of the Annual Election. All ballots are kept in the book of Minutes should you have a question as to the results.
BYLAWS
The proposed revision of the By-laws passed unanimously. All homeowners received an advance copy of the By-laws. Should you need another set, they are available for the cost of copying.
AMENDMENTS TO CC&Rs
Each homeowner was given the opportunity to vote on three amendments to our CC&Rs. Each change to the CC&RS requires 75% of the homeowners to vote YES. The Third Amendment to the CC&RS was approved with 77% affirmative. The text of the amended CC&R is attached to this newsletter. We are also providing the text of the two CC&Rs, which have remained the same as always.
TRASH CANS AND OTHER VISIBLE ITEMS
The amended CC&R requires that all ?“piles..rubbish?…trash, ?…garbage/trash receptacles?…shall be hidden from view of the street and neighboring properties?…?”. THIS MEANS THAT YOU NEED TO HAVE THEM SCREENED ON ALL SIDES. IF YOUR STORAGE SHEDS, PILES AND/OR TRASH RECEPTACLES ARE NOT COMPLETELY SCREENED YOU WILL NEED TO STORE THEM IN YOUR GARAGE OR IN THE REAR YARD BELOW THE FENCE LEVEL. IF YOU ARE GOING TO BUILD AN ENCLOSURE, PLEASE SUBMIT A DRAWING OF YOUR PLANS TO THE BOARD. This is such a large change in our CC&Rs that all homeowners have four months to comply. YOU NEED TO BE IN COMPLIANCE BY THE END OF JUNE 2003.
BELL ROAD
Bell Road work is scheduled to begin soon and survey crews are working. We ask that you make note of any trucks on our common area (write down the name of the company, the date, the make, model and license number) so we can file any necessary claims for damage to our common area.
**Once work is completed we will present a plan for any changes to the Bell Road landscaping**
WEBSITE
A website is being constructed on a community web site. The current Barclay Place web is located at www.neighborhoodlink.com/phoenix/barclay. This is a free area provided by Neighborhood Link and their advertisers. At this time, any information put on the web can be seen by the entire Internet community. Private area development is planned in the summer. So, in the meantime, please do not put any personal names, addresses or phone numbers on this page. What you can find is:

ROSTER
If you wish to have your name and number printed on a Homeowner Roster (to be given to Homeowners) please contact a Board Member. We are not handing out a complete list of homeowners as we feel a responsibility to protect your privacy; therefore, you will only be on the list if you ask to be included. You will also be given the opportunity to be listed on the web site.
ARE YOU PLANNING CONSTRUCTION OR EXTERIOR PAINT AT YOUR HOME?
Remember to submit your plans to the Board for any construction visible from the front of your home, and also to consult the current paint board. You need to have your plans approved before you get City permission. We will soon have Boards available showing the current approved colors (we are expanding the color options to provide people with a greater variety in more updated colors). You can also get a discount of 25% on all your paint at Dunn Edwards (by telling them you are a Barclay Place homeowner) ?– this includes inside paint.
WELCOME COMMITTEE
We need a volunteer for Chairman of the Welcoming Committee. If you are interested, please contact a Board Member.

CC&R AMENDMENT PASSED BY 77% OF HOMEOWNERS
Article IX, Section 5 shall be amended in its entirety to read as follows:
?“All clothes lines, equipment, service yards, woodpiles, or storage piles shall be kept screened by adequate planting or fencing so as to conceal them from view of neighboring dwellings and streets. All rubbish, trash and garbage shall be regularly removed from each lot and shall not be allowed to accumulate thereon. All garbage/trash receptacles shall be hidden from view from the street and neighboring properties in the garage, back yard or other approved enclosures except to the extent necessary in connection with garbage/trash pickup.?”
CC&RS WHICH REMAINED THE SAME AS PREVIOUSLY.
ARTICLE VI-VEHICLES
No motor home, trailers of any kind, boats and other recreational means of transportation, commercial vehicles, truck campers, whether attached or detached, motorcycles of any kind or size, or inoperable automobiles shall be kept, placed, maintained, constructed, reconstructed, or repaired on the common area or streets. No owner shall permit any vehicle of any nature including those mentioned above to be constructed, reconstructed, dismantled, or repaired anywhere on his lot which is visible from the street or any other lot. Provided, however, that the provisions of this paragraph shall not apply to emergency vehicle repairs or temporary construction shelters or facilities maintained during, and used exclusively in connection with, the construction of any improvement. Any vehicle of any nature including those mentioned above parked on the lot shall be protected from view from the street or any other lot.
ARTICLE IX ?–USE RESTRICTIONS ?– SECTION 4
No advertising signs (except one of not more than five square feet ?“for rent?” or ?“for sale?” sign per parcel), billboards, unsightly objects, or nuisances shall be erected, placed or permitted to remain on the premises, nor shall the premises be used in any way or for any purpose which may endanger the health or unreasonably disturb the owner of any lot or any resident thereof. Further, no business activities of any kind whatsover shall be conducted on any lot or on any portion of the premises, provided further, however, the foregoing covenants shall not apply to the business activities, signs and billboards, or the construction and maintenance of buildings, if any, of the builder, its agents and assigns during the construction and sale period, and of the Association, its successors and assigns, in the furtherance of its power and purposes, as herein set forth.
RESOLUTION

Board Members Eligibility Requirement
Upon Motion duly made, seconded and carried, the following Resolution was adopted by the Board of Directors on January 17, 2003.
RESOLVED:
No member, who is delinquent in assessments, may be placed on the Ballot for nomination to the Board of Directors of the Barclay Place Homeowners?’ Association.
RESOLVED:
Members seated on the Board of Directors of the Barclay Place Homeowners?’ Association must keep their Dues current or relinquish said seat on the Board of Directors of Barclay Place Homeowners?’ Association.
This RESOLUTION is an extension of Article III, Section 3 which states ?“In the event any owner is in arrears in the payment of any amount due pursuant to any provisions of this Declaration for a period of 15 days, or shall be in default in the performance of any provision of this Declaration for a period of 15 days, said owner?’s right to vote as a member of the Association shall be suspended and shall remain suspended until all payments are brought current and all defaults remedied.?” By extension, a Member who cannot vote cannot be a Member of the Board.
