BVA #5 Lost the suit, but....

If you read my previous posting, then you know I have been sued by the board of BVA#5 and called ''white trash'' at a board meeting. Another detail I omitted was, a board member, who lives on Baywood Drive, was drunk one evening and asked my husband to step out into the street to fist fight about the deed restrictions! Needless to say, my husband declined.

In an attempt to compromise, we moved the boat back on the lot next door, behind the front of our house. We did our best to make it as unobtrusive as is possible. Mr. Mark Eide took it upon himself to call the lot owner (on the night before Thanksgiving) and threaten her with a lawsuit if she did not produce a letter giving him permission to tow our boat! We had the lot owners permission to leave the boat there previously. She was very upset by Mr. Eide's tone and threats, she is a single mother with enough on her plate.
The hearing was held yesterday and the BVA#5 LOST!!!! The judge determined that the board has no authority to sue. This should have meant a happy ending, as we were willing to let things drop. Unfortunately, not the case. You see, Mr. Eide sent an e-mail to the board members today stating that they will go back to court and sue me again. They have spent $2,800 in total with their attorney thus far, they have lost the case and still they are going to put the members dues at further risk. This was not a decision of the whole board. In fact, one board member I spoke with this evening, had no knowledge of the outcome, let alone the next step. BVA#5 is being run in the shadows, without a consensus of the board, or the members, while it represents itself as doing the will of the people. These men, Mark Eide and Mark Barsky are out of control! We need to stop them. Any ideas?

Great solution for both sides!

With that kind of money the board could have offered to place your boat in a covered, protected and insured storage facility for the next five years! That would have solved their obsession, or the sick fettish they have with your boat.
Both you and those on the board would have been winners, but I'm sure this common sense solution would be outrageous to the board, better for them to spend even more of your neighbors hard earned money in futile attempts to bother you.
