If you have never been involved in a lawsuit, let me explain a few facts.

1. It is very difficult to sue a company or cooperation and win. The reason is that they will fight it for years and years. They will never settle as this will set a presidence that can be used in the future against them. Cooperations know that by out-spending and tying up time they will most always win.

2. The only people who profit in lawsuits are the attorneys.
Our lawsuit will start out at $30,000; and then, next year, it could be another 30 and so on and so forth for many years.

3. Eventually what will happen is that the homeowners will stop supporting this lawsuit and all previous money spent will be gone, and the ditch still will not be fixed. Guess who will have to pay for that? We will. Mighty expensive!

4. Expect what you inspect. If the ''ditch'' was NOT up to code why did our board members sign off and take possession?

But, in fact, not at all accurate, yet still an excellent stab at speculation. It's not hard to sue and win JUST because you sue a ''company'' or ''corporation'' (which I'm thinking is what you meant by ''cooperation''). With a good attorney, proper preparation and good history/documents, etc., it's done all the time.

It's just as likely that the lawsuit will never get to trial. Any number of things can happen along the way. But keep up the defeatest attitude. It looks good on you.

You are right. Attorney's do get paid whether they win or lose. I was thinking about paying the legal fee until now. I am re-thinking my position. I started feeling like maybe the homeowners will have to start feeding money to this issue and I am not prepared to do that.
