Q: I noticed my neighbor has put up an above-ground pool without a fence, I?’m concerned a child may drown, isn?’t this illegal?
A: State statute 515.29 requires that all in-ground or above-ground pools must be fenced to preclude drowning. If an above-ground pool, is 4-feet or higher and has a removable ladder, so long as the ladder is removed after each use, they do not require a fence. However, the association?’s ARC standards require that all pools be behind an approved fence.
Q: My neighbor has dogs that bark at all hours, especially late at night, can?’t you do something?
A: First, we suggest talking with your neighbor. If that doesn?’t work, then you can call the city?’s one-call center at 630-2489. They will help you file a complaint with animal control. You can also request an affidavit form be sent to you in the mail. This form can be signed, notarized and mailed back to animal control. On the form you will indicate the date and time as well as the specific circumstances surrounding your complaint. Once the form is received by animal control, they will respond and issue a citation to the dog?’s owner since an affidavit means a city inspector does not have to physically witness the violation. It also means that you will testify if the case goes to court. After these steps are followed you can send a copy to the association which will send the owner a violation letter for creating a nuisance. Everyone deserves peace and quiet and does not need this type of annoyance, especially late at night.
Q: What can be done about the motorized skateboards being used in the neighborhood? They are a hazard, the noise is very annoying and I almost hit a child while backing my vehicle out of my steep driveway.
A: It is illegal in the city of Jacksonville to ride gasoline powered motorized skateboards on city streets and it is in violation of the covenants to create nuisances. We have notified the owners to stop these illegal activities, however, if you see children riding these powered skateboards in the neighborhood, please call the police. They will respond and put a stop to this very dangerous activity.
Q: How come there haven?’t been regular homeowner meetings and newsletters?
A: We try to schedule meetings as needed but don?’t want to have meetings just to have meetings. When we receive enough interest or are required to hold one, we will. As for the newsletter, we only put one out when we have enough material to produce one. In the past 8 years we have not received one single article from any homeowner, so we will continue to produce them as needed to meet state requirements for meetings that require 20-day advance notification.
