Facts: On April 26, 2010 officers were dispatched to Arkwright Elementary at 1261 Lockwood Drive in the NPU S area between the Venetian Hills, Adams Park and Sandtown Communities. Officers arrived to the closed school to find three males removing items from the school and loading them onto a pick up truck. The damage to the property will cost tax payers more than $8,000.00 worth of repairs and lost items. Two of the three men arrested have previously pled. Tyrone Watley received a sentence of 20 years to serve 90 days on a non-negotiated plea before Judge Lovett on May 27th. Lester Ramey was sentenced to drug court during a non-negotiated plea before Judge Lovett on May 28th.
The remaining defendant, Vivence Murphy, has 15 previous felony convictions. Three of the convictions were for burglary and robbery, 7 others were for theft related charges. The defendant was previously offered 20 years to serve 5 years on a non-negotiated plea by Judge Karen Woodson. On May 27th, the defendant was offered 20 years to serve 2 years by Judge Lovett, however he rejected the offer.
The State is offering 20 years to serve 7 years without the possibility of parole in this case. It is not likely that the defendant will accept this offer. In addition, all new burglary cases are being handled by Superior Court Judges in the Complex Trial Division. However, this case is still being handled by the Non Complex Trial Division because it existed prior to the July 1st change for burglary cases.
