Citizens Court Watch Message April 18, 2011

 

 

 

As of February 2011, Fulton County Superior Court has three divisions for felony cases - Complex, Non Complex and Standard. The CourtWatch notices will now list the division of each case. Below there is a chart listing which division each case type is assigned to. However, the recent addition of the Standard division has created several exceptions for burglary and aggravated assault cases charged before February. CourtWatchers should become familiar with the Superior Court divisions. If you have questions about the distinctions between the divisions please contact your Community Prosecutor. A more detailed explanation of the Superior Court division can come directly from your Community Prosecutor during a CourtWatch Mini Training in your community. On March 12, 2011, officers from APD responded to a burglary in progress call on Ashby Grove in SW Atlanta.  The 911 caller stated that three males were breaking into the residence and were loading items onto a yellow pick up truck.  The caller also provided descriptions of the clothing men were wearing.  When officers arrived on the scene, they observed a male, later identified as John Jackson, loading a refrigerator onto a yellow pick up truck.  A stove and an air conditioner unit were also in the truck.  Jackson was wearing the clothing described by the 911 caller. He was detained by police.  Another man meeting the description given by the 911 caller was observed by police standing across the street from the scene.  He was later identified as Kenneth Martin.  Police went into the residence and found the air conditioning unit, stove and refrigerator had been removed.  A water heater had been damaged.  Both Jackson and Martin were arrested and are charged with Burglary and Criminal Damage to Property in the Second Degree.  This is a Standard Division Case.

On January 22, 2010, APD officers executed a search warrant in reference to illegal drug activity at a residence on Mango Circle in NW Atlanta.  While conducting the warrant search, officers located a male who was later identified as Woodward Dubois, along with Sertonius Harris and Allen Hill, the owner of the residence.  During the warrant search, officers recovered a loaded rifle and ammunition inside a bedroom closet; another rifle was recovered under the bed along with Crack Cocaine, Powder Cocaine, Marijuana and ammunition.  All three men were arrested.  Sertonius Harris is charged with Possession of Cocaine with Intent to Distribute, Possession of Marijuana with Intent to Distribute, Possession of Firearm During Commission and Possession of a Firearm by Convicted Felon.  This is a Non Complex Division Case.

On February 27, 2010 an APD officer was working a supervised checkpoint in the 1000 Austin Avenue Block in NE Atlanta.  The officer observed a tan vehicle approach the checkpoint and then attempted to turn in the opposite direction.  The driver was unsuccessful in making the turn due to the configuration of the roadway.  The driver, later identified as Joseph Harley, slowly approached the checkpoint.   As the officer requested the driver’s identification he observed the driver perspiring profusely.  The officer asked the driver if he could search the vehicle.  Harley said yes.  Seated in the backseat behind the driver’s seat was a male, later identified as Ricardo Waring.  During the search, the officer found a Ruger .45 caliber handgun, under the driver’s seat.  The officer ran a check on both of the men and found that both were convicted felons. Neither men claimed ownership of the gun.  Both Harley and Waring were arrested and are charged with Possession of a Firearm by Convicted Felon.   This is a Non Complex Division Case.

On March 14, 2011, APD officers received a burglary call from a witness indicating two males were burglarizing a residence on Peachtree Battle Avenue in NE Atlanta.  The witness provided descriptions of the suspects who were later identified as Demar Brown and Keith Perry and the white 2004 Chrysler Sebring she saw them driving during the burglary.  Both men were arrested and are charged with Burglary.  This is a Standard Division Case.

On March 15, 201, Milton Police Department officers conducted a traffic stop on Webb Road/Morris Road in Milton.  The driver of a 2007 White Dodge Charger, later identified as Monroe Lebeau, was stopped by police for speeding.  The officer noticed a strong odor of Marijuana coming from inside of the vehicle and asked Lebeau to step out of the vehicle.  Lebeau fled on foot.  Lebeau entered two vehicles with the drivers in their cars during his attempt to flee the police.  Lebeau was caught and placed under arrest.  The police conducted an inventory of the car Lebeau was driving and found a book bag containing Marijuana.  Lebeau had a large sum of cash on his person at the time of his arrest.  He is charged with Possession of Marijuana with Intent To Distribute, Theft by Taking, Criminal Attempt To Commit Theft By Taking, Simple Assault, Obstruction of Law Enforcement Officer, Reckless Driving, Speeding, Driving With Suspended License.  This is a Non Complex Division Case.

On March 30, 2010, officers from the Alpharetta Police Dept. responded to a domestic dispute call on Wood Trace Drive in Alpharetta.  Upon arrival at the residence the officers were told by the wife who had placed the 911 call that she could not able to come to the door because her husband had thrown the television on her.  She was later able to let the officers in.  The victim complained of injuries to her chest and side. The EMS was called to the scene.  The victim stated her husband, Nathan Shryock, was having issues with his job and she had made him angry.  She said she had locked herself in the bedroom to escape from him and he knocked the door down.  The police observed damage to the door, the door frame and to a television lying on the floor.  The victim stated she had attempted to call 911 but Shryock took the telephone from her, removed the batteries and smashed it and fled.  The police secured Warrants for Shryock’s arrest.  He is charged with Aggravated Assault, Criminal Damage to Property in the First Degree, Family Violence Battery, and Hindering Person Making Emergency Telephone Call.  This is a Complex Division Case.

On October 20, 2009 a burglary was reported at Heritage Parkway in East Point, GA.  The perpetrators stole 3 flat screen televisions, a computer, shoes and a Sony Play station 3.  The perpetrators were described as four males and were observed leaving in a blue SUV.  Later on the same date, a citizen reported suspicious activity at the Cityscape Apartments.  The caller and the two witnesses reported observing two blue colored SUV’s parked in the parking lot area of the apartment complex.  The witnesses copied down the registration tags of each vehicle.  Several younger males were transferring televisions and other electronics from one SUV into the back of another.  The five occupants denied ownership of the electronics in the SUV.  Keys for one SUV that was reported stolen were found on Defendant.  This Defendant was charged with 1 Count Burglary and 2 Counts theft by Receiving Stolen Property.  This is a Complex Division Case.

On March 17, 2010, Fulton County Police responded to a prowler call in a subdivision on Fern Bay Drive in South Fulton County.  A witness reported seeing several males running from the rear of a residence in the subdivision on Reel Lake Drive.  He reported seeing a U-Haul truck with two male occupants.  The description of a second vehicle was given.  As the U Haul was leaving the scene, an officer arrived and saw two men jump from a U-Haul Truck while is was in motion.  The two men ran into a nearby wooded area.  Police conducted a search of the area.  Two men, later identified as Aaron Jefferies and Ryan Leonard, were seen by police, walking in the area covered with mud, with torn T shirts and multiple scratches.  The two men were detained by police.  After further investigation, police found the U-Haul and inside was a refrigerator, a dishwasher and a kitchen range.  Robert Crawley and Roderick Bates were identified as the subjects who participated in the burglary on March 17th with Leonard and Jeffries.  Warrants were issued for Leonard and Jefferies.  All four men were subsequently arrested and are charged with Burglary.  Jefferies is also charged with Obstruction of a Law Enforcement Officer and Giving False Information to a Law Enforcement Officer.  Ryan is also charged with Obstruction of a Law Enforcement Officer.  This is a Complex Division Case.

The victim was walking home when Accused Myeshia Harris approached. They got into a verbal dispute.  The victim turned to walk away.  Defendant Harris shoved the victim to the ground.  She covered herself up and the next thing she new, a silver car pulled up and a man got out of the car and beat the victim about the head, shoulder and back with a bottle.  The defendant Harris and the unknown man then fled.  Subsequent investigation revealed the identity of Defendant Myeshia Harris and arrest warrants were issued.   The unknown male assailant has not been identified.  The Defendant was arrested and charged with 2 Counts Aggravated Assault with an Object and Aggravated Battery.  This is a Complex Division Case.

On December 4, 2010, APD officers responded to a call from a neighbor of the owner of a residence on East Ontario Avenue in SW Atlanta.  The neighbor stated he had been asked by his neighbor to watch his residence and walk his dog while he was away.  The neighbor reported to the police that he saw that one of the doors had been kicked in at the neighbor’s residence.  In addition, the neighbor stated that the victim’s laptop computer was not on the kitchen counter where it was kept.  The matter was also reported to police by an individual who stated her sister informed her that Javarras Samuel, her former boyfriend, had broken into a residence on East Ontario and brought the stolen items to her home.  In addition, the caller saw her juvenile brothers with the property.  Arrest warrants were obtained for Javarras Samuel and the two juveniles.   Samuel is charged with Burglary.  This is a Complex Division Case.

On September 27, 2010, APD officers responded to a “shots fired” call on Honeysuckle Lane in SW Atlanta.  The called indicated she found five bullet holes in her front window.  Her son left the apartment to investigate.  He encountered two males he knew on Myrtle Drive.  One of the males shot up his vehicle.  He later identified Cieric Howard as the individual who shot up his car.  The police secured arrest warrants for Defendant Howard who was later arrested and charged with Aggravated Assault, Criminal Damage to Property in the Second Degree and Possession of a Firearm During Commission.  This is a Complex Division Case.
