Halfway Houses in the Community

“SELL OUT” of COMMUNITIES, HOMEOWNERS and the

VOTERS in the STATE of Illinois? 

House Bill 4446 – Public Action 94-0946 approved on June 27, 2006 by the Governor and became effective January 1, 2007. 

In the amended bill our “Rights” as voters, homeowners and citizens to be “ALERTED” when “Halfway Houses/Transitional Houses” for parolees and mandatory released offenders are being established in our communities was taken out of the original bill. 

The following provisions removed from the “OLD” bill were a prerequisite for those wanting to establish halfway/transitional houses in our communities. They were required to:

  • Obtain the signatures of residents within 250 feet of the proposed halfway/transitional house on a form that acknowledged the consent of the residents for the halfway/transitional house at that location.
  • Must comply with local zoning ordinances to establish or maintain halfway/transitional house.
  • Establishing or maintaining halfway/transitional house without complying with the provisions is a Class A misdemeanor.
  • Failure to comply with local zoning ordinances a $1,000.00 fine would be assessed for every week in violation in addition to any other locally imposed fines.

 

In the “NEW” amended bill – (730 ILCS 5/3-14-4.5)

  • A definition of a “Halfway House” is given.
  • Any person or entity who intends to establish a halfway/transitional house shall comply with all applicable local ordinances and permitting requirements.
  • Not more than 48 hours after placement in a halfway/transitional house a written notice will be given to the State’s Attorney and the sheriff of the county and the proper law enforcement agency of the municipality in which the halfway/transitional house is located.
  • Failure to comply with the notification requirements is a petty offense for which a $1,000.00 fine shall be imposed for each offense.

Petition and letters have been sent to State Representative Howard and Senator Trotter with our concerns about these type of businesses coming into our communities.  These were sent before we were informed that the Bill 4446 had been changed.In the petition and letters we were arguing our position based upon the old bill.
