RULES AND FINES

Pursuant to A.R.S Sections 33-1242 and 33-1803, after notice of the violation and an opportunity to be heard, a community Association may impose reasonable monetary penalties on Owners for violations of the Declaration, Bylaws and Rules of the Association. These penalties are enforceable in the same manner as unpaid assessments.

In accordance with power given to the Board of Directors by ARTICLE VII of the BYLAWS OF COUNTRY HOLLOW HOMEOWNERS?’ ASSOCIATION, INCORPORATED the Board of Directors has adopted the following Rules and penalties for infraction of those Rules to help govern Country Hollow impartially. They serve only to supplement and clarify the intent of the CC&Rs and Bylaws and do not replace either. By their nature, they are more specific than either, but they are not meant to be all inclusive. The Board will edit and modify them as deemed necessary by future events.

I. Assessments. ARTICLE V.
By accepting a deed to property in Country Hollow an Owner is deemed to covenant and agree to pay assessments to Country Hollow Home Owner?’s Association. A thirty-day grace period is given to pay quarterly assessments. At the end of thirty days, a $10 late fee will be added to the Owner?’s account if assessments are not paid. Additional charges may be made to the Owner?’s account by the Management Company or Collection Company if accounts remain unpaid. The Board intends to keep all accounts current, and the cost of efforts to bring delinquent accounts current will be borne by the Owner. ARTICLE V Section 1.

II. Maintenance. ARTICLE VI Section 2 & ARTICLE X Section 16.
Each Owner is responsible for maintaining his own property.
A. The exterior of his home and fence shall be kept in good repair and well painted.
1. Dunn Edwards approved paint house colors are: EX 56 Navajo white, EX 70 Pearl White, EX 14 Baja White.
2. Dunn Edwards approved trim colors are: EX 56 Weathered Brown, EX 136
Bridgewater Blue, EX 135 Banks Blue (dark), EX 137 Blue Shadow (light)
EX 161 Tamborlane (Rust).
3. Sherwin Willims approved house colors are: SW 2060 Casa Blanca (white),
SW 2445 Creamy White, SW 2446 Edelweiss (white).
4. Sherwin Williams approved trim colors are: SW Gambrel Brown, SW
Domicile Blue (light), SW 2224 Newport Blue (dark), SW 2173 Shaker Red
(rust).

B. Landscaping visible to neighboring property shall be kept alive and well groomed. Dead bushes and plants shall be removed and replaced without delay. However, the Board will recognize reasonable delays during extreme summer heat and monsoon season
C. Shrubs and trees that become a hazard to the right-of-way shall be brought to the attention of the homeowner by the Board of Directors. Then the homeowener shall cure the defect.
D. The costs of maintenance and landscaping work approved by the Board and performed by a contractor will be charged to the Owner. The charge will be deemed an assessment collectible as with other assessments.


III. Use Restrictions. ARTICLE X.
A. Noxious and Offensive Activities. Section 3.
No Noxious or offensive activity shall be carried on upon any part of the lots nor shall anything be done thereon which may be, or may become, an annoyance or nuisance to the neighborhood, or which shall in any way interfere with the quiet
enjoyment of each of the Owners of their respective lots and improvements thereon.
B. Temporary Structures. Section 4.
1. No temporary structure shall ever be used as a residence.
2. No temporary structure shall be visible from the street or from neighboring properties.

C. Vehicles and Recreational Equipment. Section 5.
1. Abandoned or inoperable vehicles shall not be stored anywhere in Country Hollow so as to be visible from neighboring properties or from the street.
2. No visible recreational vehicle of any description shall be allowed to remain in Country Hollow overnight. 3. Utility trailers of all kinds shall not be stored anywhere in Country Hollow so as to be visible from neighboring properties or from the street.
4. Trucks larger than 10,000 pounds Gross Vehicle Weight Rating (GVWR) are not allowed on residential streets unless providing a service, Glendale City Ordinance Sec. 5.312B and Sec. 24-191. GVWR means the weight of the truck plus the weight it can carry or pull.

D. Animals. Section 6.
1. Breeding of all animals is prohibited in Country Hollow.
2. Household pets may be kept on or within the Owner?’s lot. Animals permitted to leave the Owner?’s lot:
a) must be on a leash.
b) are not permitted to run freely in the common areas -- our parks.
c) must have their defication cleaned up by the animal?’s owner.

3. A reasonable number of pets may be kept by each household. Reasonable means:
a) no detectable odors,
b) no obnoxious noises,
c) no abuses to neighboring properties,
d) no danger to community.
e) no unsanitary conditions.
f) waste removed from property frequently.

E. Trash, & Fencing. Sections 8, 9, & 11
1. Rubbish, trash, and garbage shall be regularly removed from the lots.
2. Containers for storage and disposal of such materials shall be kept clean and sanitary.
3. Containers shall be stored is such a manner as not to be visible from the street or neighboring properties.
4. Containers are permitted on the street from the evening before collection dayuntil the evening of collection day.
5. All items in the back yard shall be below the fence line unless written permission is obtained from the Board.

F. Temporary Window Covering. Section 12.
1. Material, color and time must be approved by the Board.

G. Garage and Related Restrictions. Section 13.
1. Garage doors are to be kept closed at all times except when necessary for access to and from the garage
3. Driveways are to be kept free of oil and rust stains. A minimum of 30 days will be allowed to remove such stains after notification to the lot owner.

H. Roofs. Section 15.
1. Anything installed on or around the roof will be seen by someone in the community. Therefore, installation of such items must be preapproved by the Architectural Committee.

IV Fines.
Violations may be subject to a fine at the discretion of the Board of Directors of Country Hollow Homeowners Association if the violation is not corrected or if the fine is not disputed by the homeowner and waived by the Board of Directors. Fines may be disputed by letter to our management company or orally at a Board meeting. Oral disputes must be arranged with the management company.

V. Suspension of Rights.
A members Association rights may be suspended if the Association provides fifteen (15) days notice and an opportunity for a hearing. The hearing shall be at least five (5) days before the effective date of the suspension of member?’s rights.
