Meeting Minutes

This meeting was called to satisfy our annual requirement to discuss the issues and concerns of all of our Association Members. We also hope to elect new Board members to assist us in conducting our association in a professional manner.

1. Neighborhood Safety
a. Cindy Mitchell was robbed three weeks ago.
b. The Melendezs were broken into, during the day, two weeks ago.
c. We need to organize a community watch!
i. This requires a 40% participation of the homeowners (i.e. 10 households)
ii. Please sign up to commit to assisting with this important effort.
d. Safety Tips will be shared with us by Ron Selleck.
e. Annette Melendez will present the Community Watch information.
2. Dues delinquencies.
a. Letters have been sent to all members who are delinquent on their dues.
b. What is the status of the response to these letter?
i. The letters were sent out at the beginning of September.
ii. A lien will be applied to the delinquent properties as soon as possible.
3. We have engaged the services of a lawyer.
i. According to the bylaws of the association, this task is the responsibility of the lawyer retained for the association?’s service.
1. It is necessary to have legal representation to enforce our bylaws.
2. The legal representation information will be disseminated during this meeting.
4. Amending our Covenants & Restrictions.
a. Listed below is the wording for the No Parking on the street restriction.
i. AMENDMENT I: PARKING
1. Section I: Daily Parking On The Street
Parking on the street at any location on Eden View Court or Eden Park Road presents a safety hazard to the residence of the Eden East community. This practice will therefore no longer be allowed for a duration longer than two (2) hours at a time. The two (2) hour allowance is permitted for purposes of performing lawn maintenance of the appurtenant lot. Parking on the street for any length of time is strongly discouraged. Vehicles remaining parked on the road for a period longer than two (2) hours will be considered in violation of the Eden East Homeowners?’ Association Restrictions.
2. Section II: Special Event Parking On The Street
Should an occasion occur that requires an allowance for guests to park on the street at any location on Eden View Court or Eden Park Road for a duration longer than two (2) hours, an Eden East Homeowners?’ Association Member (owner) may petition the Board of Directors for a temporary stay of this bylaw. Permission must be obtained from the Board of Directors at least twenty-four (24) hours in advance of the event. Any neighboring property owners must be advised of the event twenty-four (24) hours in advance as well. Permission for acceptable events will be granted at the sole discretion of the Board of Directors.
b. The No Parking Signs petition is currently on hold. Some residence are not keen about having the signs installed in their front yard.
c. A notice has been distributed to every household to inform them of this amendment.
d. According to the Covenants & Restrictions the Board has the right to amend this document. This document does take precedence over the by-laws.
i. Section 6 Amendments: This Declaration of Covenants and Restrictions may be amended by two-thirds (2/3) vote of the Board of Directors of the Association and any such amendment shall thereafter be recorded in the Public Records of Seminole County, Florida, and shall thereupon become a part of this Declaration of Covenants and Restrictions as though the same were first set out herein.
ii. ARTICLE XV Amendments: These Articles may be amended by a majority vote of the Board of Directors; provided that no amendments shall be effective to recorded covenants and restrictions applicable to The Property (as, for example, membership and voting rights) which are part of the property interest created thereby.
5. Dues Increase
a. The last time we had an increase in dues was in 1996.
b. To maintain an equivalent value to our dues we will have to increase our dues from $60/yr to $70/yr
i. $60/yr in 1996 = $72.24/yr in 2004.

c. Dues will reflect this increase no later than 01/01/2007.
d. The Association?’s Board of Directors may adjust the annual assessment after the end of each Calendar Year.
6. ReNew Grant Status
a. We may fill out a grant application for our front gardens.
i. We will still need 10 households to agree to volunteering to assist with the improvement.
1. Who will volunteer to participate in this effort?
2. Volunteer responsibilities will be minimal.
ii. Are we interested in having an irrigation system installed in our front gardens?
1. We will probably have to set up an account with OCU to pay for the water through the HOA.
2. The grant will pay for installation.
3. To get grant approval we will have to have a really good maintenance plan!
7. Front Garden/Grounds Maintenance
a. Mr. & Mrs. Melendez recently cleaned up the front gardens at no cost to the Association. Our gratitude is due them.
b. Does anyone have a suggested vendor for maintenance of the common area?
i. What is the cost of this kind of service?
ii. We need to find a service at a reasonable price.
8. Please Thank Mr. Burce for getting Orange County to come out an repair the two holes on our cul-de-sac. He has also had Orange County inspect the condition of our sidewalks and needed repairs are underway.
9. Election of New Board Members
a. We currently only have 4 active Board members.
b. It would be ideal to have one more person on the Board to allow for an odd number
i. An odd number will prevent a hung decision when voting.
c. The current Board members are Annette Melendez, Dominidor Burce, Cindy Mitchell, and Ronald Selleck.
i. Are these officers to be retained at their posts?
ii. Are these officers willing to continue serving at their posts?
