All residents of Evergreen Park Estates should consider signing the petition, below, expressing opposition to the front setback exception granted by Jefferson County on the lot at 29684 Lee Road (Hagan). The petition will be presented in support of the appeal by adjacent property owners and MUST BE SIGNED BY FEBRUARY 27.

PETITION ON APPEAL OF FRONT SETBACK EXCEPTION
Evergreen Park Estates, UNIT 7, LOT 20, aka 29684 Lee Rd., Evergreen, CO 80439

We, the undersigned property owners of Evergreen Park Estates, do hereby petition the Jefferson County Board of Adjustment to rescind the Administrative Exception for the above-cited property allowing a front setback of 22.5 feet, where 30 feet is required, for the following reasons:

?· The proposed setback is uncharacteristic of developments in the immediate area and the subdivision.
?· The property owner has failed to demonstrate a verifiable hardship to justify the exception based on the Zoning inspector?’s report and the site plan submitted with the exception application.
?· The property owner is currently in violation of Jefferson County Health Department regulations, the site-specific septic system permit, and Colorado State water quality regulations regarding separation of well and septic system.
?· The Jefferson County Planning and Zoning Department failed to properly notify the Evergreen Park Estates Homeowners Association of the proposed exception although the HOA was properly registered for this purpose.
?· The Jefferson County Zoning Administrator failed to document any basis or justification for the issuance of the exception.
?· The Jefferson County Zoning Administrator failed to respond to detailed technical points of objection timely filed by adjacent property owners.
