Resolution on 640 Beach Dr. N.E.

The NSNA Board submitted a letter and a petition signed by NSNA members to City Development Review Services and to the Board of Adjustment objecting to the reinstatement of office use in a residentially zoned district at 640 Beach Dr. N.E. These items were made a part of BOA members' packets on this project. NSNA sent two representatives to speak at the hearing on Jan. 26, but in spite of being registered to speak, the zoning official took the case out or order to accomodate the representative for the applicant.
The BOA approved the application. I faxed a letter to Development Review Services objecting to the BOA process that excluded our representative from speaking. I also informed them that, following legal consultation, we believed their decision to be beyond their legal authority according to City Code. A few days ago, I received a letter from John Hixenbaugh, City Zoning Official, stating that the decision had been rescinded because the BOA had acted beyond its legal authority. The only use permitted for that structure is residential/residential multi-family 24-30 units per acre.

Thank you for protecting our residential area. There are many areas of the city which need new office space and have the proper zoning. And bravo for standing up to the staff person and the BOA, as it would seem likely that as our area becomes more and more desirable, we will have more such applications.
Need the City be reminded that the renaissance of commercial downtown is due primarily to the resurgence of residential properties
in and near downtown ?
