Any infraction of the CC&R's, By-Laws, Rules and Regulations or Policies approved by the Fountain Shadows Board of Directors may result in a fine to the owner of a property. The fine structure is another option of penalties which can be imposed by the Board of Directors concerning violations (Reference: CC&R's, article II, SectionI[e], and By-Laws, Article V (Directors Section 2).
First offense Written Warning
Second offense $ 100.00 fine
Third offense $ 200.00 fine
Each additional offense $ 200.00 fine
Each violation notice to be delivered by certified mail or hand delivered.
A continuing third offense will generate an additional $ 200.00 fine every ten (10) days until the situation is remedied.
After a third offense letter has been issued and the violation has not been remedied by the homeowner, the Association may hire an outside vendor to correct the situation and charge the homeowner for all costs.
PARKING VIOLATIONS WILL BE HANDLED AS FOLLOWS:
PARKING: FIRST & SECOND OFFENSES ARE ARNINGS/TICKETS.
THIRD OFFENSE WILL BE TOWING OR FINES OF
$ 100 & $ 200 FOR EACH ADDITIONAL OFFENSE.
Any fine not paid by its due date, as set forth in the CC&R's or as set forth by the Board of Directors, will bear a late fee of $ 10.00 per month until paid in full.
All such charges will be secured by a continuing lien or a judgement on the applicable owners property.
A hearing may be required in writing by the owner, with the exception of a continuing third offense. Should a hearing be requested in writing, said hearing will be scheduled.
