Board Hearing Procedures

PURPOSE:

The purpose of the Hearing Board is to hear evidence presented, determine if the violation did occur and decide if a fine should be imposed as a penalty for said violation.

PROCEDURES:

1. The hearing will be scheduled and the homeowner will be notified at least ten (10) days before the meeting. The hearing will be recorded for the purpose of record and documented evidence.

2. The hearing will be limited to 30 minutes for 5 minutes per person involved in the hearing. The offender and the Board representatives will be allowed to present two (2) witnesses each, if necessary. All witnesses must be homeowners in good standing.

3. No attorneys or outside persons other than Fountain Shadows Homeowners may attend any hearing. Homeowners may only attend if they have been invited to be a participant in the hearing or a witness.
