Greater Bell Road Neighborhood Association By-Laws

We Know That They Need Revision...

Our currently approved By-Laws are presented under the next heading. These are the original documents that were created when the former Fairfield Neighborhood Association accepted the Belmont Downs and Brewbaker Estates subdivisions, and therefore became the Greater Bell Road Neighborhood Association.

We know that they need revision, and we've already started working on it. If you would like to help us with this task, please contact Jim Wirshing at 260-9538.

BY LAWS OF THE GREATER BELL ROAD NEIGHBORHOOD ASSOCIATION

FKA FAIRFIELD NEIGHBORHOOD ASSOCIATION

The Association is Mandatory


ARTICLE 1: NAME

The organization will be known as the THE GREATER BELL ROAD NEIGHBORHOOD ASSOCIATION

ARTICLE 1: PURPOSE

Section 1. The purpose of the association is to promote a closer relationship between residents and a safe, well-kept community.

Section 2, To reach out to every person and let them know that the association is there working for them.

Section 3, To help maintain the integrity and the character within the community.

ARTICLE III: MEMBERSHIP:

Membership will be solely of homeowners and renters in the community, however, membership will not be restricted because of age, race, creed, sex nationality, or religion. A meeting will be held monthly of the calendar year at Morning view Baptist Church on the 2nd Monday of each month at 6:30 p.m. for the neighborhood and the board of directors and officers will meet at a time set forth by the President.

ARTICLE IV: FEES AND DUES
Dues in the amount $30.00 set by the Board of Directors will be due no later than your Anniversary date of each year. The budget was approved for next year. The news letter will be Monthly unless there is a special event, then a special edition will be published.

ARTICLE V: BOARD OF DIRECTORS
There shall be a five (5), member Board of Directors shall be appointed by the President. The board will have the authority to elect the officials, PRESIDENT, VICE PRESIDENT, SECRETRARY, TREASURER, SARGENT AT ARMS AND CHAPLAIN, which will be known as the Executive Committee. There will be no term limits placed on the Executive officers, or the Board Members unless a pole vote is consummated. Each person must run for reelection. Board members may vote for absentee members by written proxy. There will be only one vote per household. If a person puts their home up for sale, they must relinquish their position. No husband and wife can serve as an official example (husband president, wife, secretary), also this will apply to the board of directors, however they may serve as one on the board and one as an official with the approval of the board. Also, we need to adopt rules for impeachment. The board will have authority to succeed themselves or appoint themselves to another position.

ARTICLE VI: DUTIES OF THE OFFICERS

1. The President will preside and conduct official business at all meetings, and ensure that all duties are being handled in the proper business manner.
2. To appoint a person or persons for the purpose of signing and countersign checks and other instruments for the association with the approval of the Board of Directors. Any check over ( $50.00), must be approved by the Board without hesitation. Also, the president, vice-president and Chairman of the Board will have a copy of the bank statements as will as the treasurer.
3. To appoint a successor to any Association position, with the approval of the Board.
4. The vice-president will have the same duties as the President without prejudice. Any official that is out of town must notify the President or vice-president. The President will keep the Vice President informed at all times, and vice versa. The vice-president is to assume all duties in the absence of the President.
5. THE TREASURER: The Treasurer is responsible for of all vouchers and receipts must be turned over to the Treasurer with no exceptions. The duties will be to make deposits, give a monthly report to the president, & keep an accurate record of the check book.
6. THE SECRETARY: Will attend all meetings and keep minutes of transactions and give a progress report at each consecutive meeting. Should the secretary be absent, an electronic recording of the meeting will be made. The Secretary will maintain a copy of correspondence, submit records for auditing purposes and conduct business as needed, as directed by the Board on behalf of the Association.


ARTICLE VII: BLOCK CAPTAINS

1. Each Block Captain will have no more than (10) homes unless otherwise instructed by the President. They will be selected from the neighborhood. They will pass out flyers, notices, and inform homeowners in their designated area of events and meetings. They will be responsible for getting new members. The homeowners in their area will report activities of concern the Chairman of Block Captains and the Chairman will inform the President or Vice-President. Their meeting will be held upon the request of the President or vice-president. There is a training class for the block captains to attend. The president and the vice-president will govern the actions of the block captains and then bring it before the board. The board must approve the block captains.


ARTICLE VIII: THE EXECUTIVE COMMITTEE

The Executive Committee will consist of the President, Vice President, Secretary, Treasurer. They will approve and manage affairs and present issues to the Board for approval. The President will call a meeting at any given time requesting the presence of the Executive Committee. A quorum will be established when a majority of the Executive Committee is present.

QUALIFICATIONS FOR BLOCK CAPTAINS:
1. A paid member
2. Attend every meeting
3. Must set and example for the neighborhood?
4. Must be available
5. Must be willing to meet the needs of the neighbors
6. Must be willing to enforce the By Laws


RESOLUTION

The Association has agreed to adopt the City Ordinances, along with Original Plat that was initiated in the year 1992, when the Fairfield Subdivision was first constructed. These documents will be put into effect and enforced to its entirety. In addition to the all applicable laws, rules, regulation and resolution the following areas are of repeated concern and therefore warrant mention……

THIS WILL BE ENFORCED WITHOUT HESITATION

1. Lawns well maintained, This includes edging and removing debris.
2. Garbage cans kept in the back of the house (I.E.,out of view from the street).
3. Streets in front of the house kept clean of litter and excess debris.
4. Animals kept in a fenced, secure area, and/or on a leash (including cats.) These animals are to be vaccinated and have a tag. This is mandatory
5. If you walk your dog, take a scoop and pick up after your pet. You must pick up the litter from your animal. Any reports brought to the attention of the association, the City will be called. This will be strictly enforced.
6. No unsightly debris in-view from the street.
7. Trees and shrubs will be trimmed and kept neat
8. Side walks cleared of debris and grass
9. In accordance with applicable laws, there should be no excessively loud music
10. Use of Profanity, drinking alcohol prohibited in front of minor children.
11. Obey all speed limits (this is a must). Strictly enforced
12. No parking on the grass in the front yard city ordinance #36-96 section 7, permanent parking prohibited.
13. No broken down vehicles in view from the street.
14. No parking on the streets, this is a hazard to children and Grownups. If your drive is empty, your vehicles must be in the drive. This is in our original plats. Also is very much a hazard to emergency vehicles and could mean the difference between life and death. This includes fires. No trailers are to be parked at any time on the streets.
15. No loitering
16. Garbage can, must be moved the same day the garbage is picked up.
17. No parking in front of the mail box. The postman will Not deliver your mail.
18. Per the city of Montgomery, home owners with a berm on their property are responsible for removing unsightly growth, garbage and keeping the grass trimmed. There will no longer be any dumping of rubbish behind the fences. This produces a breeding ground for rodents, rats, flies and mosquitoes. The Association, along with the city will enforce these laws.
19. If you have a yard sale, signs can only be (18” x 18”). You are responsible for putting out the signs and picking them up the same day. If the signs are left out, it will be taken before the board of directors for the discussion of a fine to be imposed.
20. No motorized scooters allowed on the streets. These are made for bike trails, parks Etc.

Let it be understood that the formation of the association is for bringing the community together, to maintain a safe, pleasant, community. By following the by laws, we develop integrity and excellent character and a community that everyone is proud to be a part of. This neighborhood belongs to everyone, not one person.


As we unite, we present and convey to you all of the above. Any resolutions must be voted on and agreed upon by the Board.
