I am contacting DNREC and the City of Milford to site Violations of Delaware State Law under the Sediment and Stormwater Law Senate Bill 359 and Amendments of sec. 4003, and sec 4008, which explicitly gives the City the right to act. Sec 4012 which requires review and enforcement of ongoing construction, suggesting and furthermore requesting a cease and desist order to Lacrosse until the grading is complied and also requesting a refrain from issuing of any further building permits until the sites listed but not limited to are remedied - Lot 176, 175, 177, 170, 183, 181, 171.
I also ask that in accordance to sec. 4015 of the above bill that monetary fines and sec. 4016 Injunctions are carried out per Delaware law for each violation, which will remain seperate. I will ask that the Chancery Court of Delaware act as they see fit to the penalties and remedies sought to correct the situation and enforce the act of each day and violation constitute a seperate offense (sec. 4015)

This request has come after numerous phone and personal contact attempts to remedy this situation. I have spoke with Jack of Lacrosse Homes by phone 7 times. I have spoken to Gary of Lacrosse Homes 3 times in person. I have contacted the main office of Lacrosse as well as the model home.
I have spoken to The City of Milford Utility Inspector by phone. I have also spoken with the City of Milford on seperate issues regarding the tall grass on the vacant lots of Orchard Hill.
My first contact with Lacrosse on this issue was March 15, 2008
My first contact with the City of Milford was May 15th, 2008
Recently on May 29th, dirt was delivered and spread on the lot behind mine. This dirt was pushed onto my lot and with the rain on May 31, 2008 has caused run-off onto my lot. The dirt is full of road particles, broken glass, and other foreign objects unsafe for suitable developed lot conditions.
