Pool Use and Band Agreement

Heritage Lake Pool Use Agreement & Waiver

In consideration for the Heritage Lake Homeowners Association allowing the non-exclusive use of
the pool and related recreational facilities located in Heritage Lake subdivision (hereinafter “Pool”),
I, the undersigned, agree as follows:

1. I assume all responsibility, risks, liabilities and hazards incident to my use of the pool and
hereby release and forever discharge the Heritage Lake Homeowners Association
(“Association”) and their officers, directors, and employees, agents, and members, past,
present and future, from any and all claims, costs, causes of actions a liability for personal
injury or death and damage to or destruction of property arising from my use of the pool.

2. I agree to indemnify and hold harmless the Association and their officers, directors, and
employees, agents, and members, past, present and future, from any and all claims, costs,
causes of actions a liability (including but not limited to attorney’s fees) resulting from
negligence or otherwise for an injury, to any person or property, suffered by me, my family
members, employees, agents, guests, invitees or any member of the Association or any other
person which arise from or are in any way related to my use of the pool.

3. I assume all responsibility for the actions and behavior of all persons present at the pool at
my request or Invitation or as a result of this Agreement and agree to be personally
responsible for any damage and for causing all such persons to comply with the rules and
regulations concerning pool use.

4. I have carefully read and understand the Heritage Lake Pool Rules and Regulations.

5. I have carefully read and understand this agreement and agree to be bound by its terms.

Heritage Lake Pool Band Release

To assure the pooi is reserved for the exclusive use of the members, pooi bands are used to identify
members. Those not wearing a band at the pool will be challenged to leave.

Regular pool bands will be issued, at no additional cost, to each family member living with an
Association member over the age of 6. In addition, four (4) guest bands (different color) are available
to each family at the cost of $5.00 each. These (4) guest bands are good for one year and must be
renewed annually. Additional temporary guest bands (maximum of four additional) may be
purchased at a cost of $3.00 each and are good for a period of one (1) week.

In consideration for non-exclusive use of the pooi facilities located in Heritage Lake subdivision, I,
the undersigned, agree as follows:
1. I understand the members in my household over the age of 6 are required to wear
membership bands at all times while at the pool facility.
2. I understand that the membership bands are to be used by Heritage Lake Homeowners
Association members only and that use by non-members may subject me to losing my
privileges to use the pool facility.
3. I understand that there is a replacement fee of $5.00 for each regular or guest band that
becomes lost or stolen.

Members of the Heritage Lake Homeowners Assoc. who have not paid their annual assoc. dues, will not be permitted to use the pool facility, including their families or guests.

To utilize the pool facility, each adult member must have signed the “Heritage Lake Pool Agreement” and a “Band Release Form”.

No Life Guards are on duty and swimmers swim at own risk.

H.O.A. members and their guests may use the pool at any time during the scheduled hours of operation posted at the clubhouse.

No Children under 14 years old are allowed in the pool without adult supervision.

All members and guests age 6 and above must wear colored pool bands. Individuals will be asked AND required to leave pool area, when they are not in possession of a pool band.

Parents / Members are responsible for their children or guests at all times, whether or not the parent / member is present at the pool

Proper swimming attire is required. ( No Cut-Offs ) Wet swimwear is not allowed in the clubhouse at any time.

No bobby pins, barrettes, hair bows, clips, combs, or bands are allowed in the pool. Elastic bands are acceptable.

No running, pushing, rough-housing or jumping backwards into the pool.

Non-toilet trained children must wear rubber fitted pants and swim suits.

No gum, chewing tobacco, or smoking is allowed in the pool facility.

No glass containers are allowed in the pool facility….plastic or cans only.

Please, No abusive or foul language.

No pets are allowed in the pool facility.

No bicycles, rollerblades, skateboards, etc are to be brought into the pool area.

No swimming with open wounds or infections.

Members who are asked to leave the pool must obtain permission from the H.O.A. board of directors to return.
