Special Meeting on May 24, 1999

At the recent annual meeting, there was a long discussion concerning the diving board at the pool. As we could not have all of the discussion that the owners in attendance wanted, we indicated that we would call a special meeting in order to hear from everyone and better explain the Board?’s policy for removal of the diving board.

The meeting is set for May 24, 1999, at 7:30 p.m. at the St. Joseph?’s Episcopal Church, 11202 West Jewell Avenue, Lakewood, Colorado.

Your Board made a decision some time ago to remove the diving board from the pool. We did so after considerable debate of the pros and cons. The elements of our decision are as follows:

Appropriate Use. Our responsibility is to ensure safe use of our facility as the #1 priority. We employ a lifeguard. We limit use after the lifeguard leaves. We fence the pool area and secure access. We secure the pool gate after posted hours. We attempt to the best of our ability to regulate safe behavior from all users (i.e., no running, pushing others into the pool, etc.). Unfortunately, many individuals do not have the skill to appropriately use the diving board or they choose to use the diving board in an inappropriate manner. For example, playing on or hanging from the diving board.

1. Insurance & Liability Issues. Currently, the Association carries $2,000,000 in general liability and $1,000,000 in an umbrella policy. Our attorney has informed us that there is the potential that all homeowners could be held liable for monetary damages in the event there was an injury associated with a diving board accident which resulted in a judgment which exceeds the insurance protection carried by the Association.

For example, if we are insured for $3,000,000 and there is an award of injuries of $7,000,000 for a severe injury (i.e., individuals are rendered a paraplegic or quadriplegic), the existing homeowners could be legally assessed for the difference between the $3,000,000 insurance coverage and the amount of the award. This would amount to $17,400 per household. How likely is this outcome? It happened 2 years ago in California. It could easily happen here. Would a case like this be appealed? Certainly, it could ?– with attendant legal fees accumulating to all of us.

2. Responsibility. Your Board has a duty to represent the homeowners?’ best interests. We take that duty to heart and act as necessary. To do otherwise would be a breach of our fiduciary duty. The overwhelming
majority of associations like ours has taken their diving boards out or has declined to install them. They tell us they did so because of the safety and liability issues.

A proxy was included in the original notice. If you cannot attend, please remember to return the proxy to Tyler Community Management in the envelope provided with the original notice.

It?’s not too late to be in the neighborhood sale. We can only have a garage sale once a year so this is a great opportunity for spring-cleaning. The sale will be three days this year, so other families could be included. The hours that are advertised in the paper are 8:30 a.m. to 4:30 p.m. Please try to mark your house (balloons work great on the light post) and corner. I will do the entrances.

Please drop your $5 off to Debbie Weeter at 2057 South Robb Way. The $5 per garage is to cover the cost of supplies and newspaper ads. Every year we have a few homeowners that do not pay, please try to be fair to your neighbors. If you have questions, please call Debbie at 303/989-1440.


Architectural Advisory Committee Report

Since our last report, the Committee has approved the following:

1. Positioning of a TV cable on the exterior of the home at 2168 South Parfet Court; and

2. Modifications to landscaping at:

11362 West Baltic Court
11264 West Asbury Avenue
11435 West Atlantic Avenue.

Please note that the Architectural Guidelines Manual is not a static document. Specific guidelines may change as technologies, styles, new products, and other factors change. Accordingly, any part of a proposal to the Committee not completed within one year of the original approval date needs to be resubmitted to the Committee for a second review and re-approval.

The Committee plans to meet during the middle of May if there are enough additional requests. Otherwise, we will handle requests as received. Please submit any plans to the Committee as soon as you can. In order to expedite approvals, please submit proposals that are as detailed as possible and include styles, colors, and your name, address, and telephone number on the request.

AMENDED Carousel Pools 1999 Swim Lesson Catalog


Dates: Session 1 June 7-17
Session 2 June 21 ?– July 1
Session 3 July 12-22
Session 4 July 26 ?– August 5

Days: Monday, Tuesday, Wednesday, and Thursday

Times: Mornings 10 a.m. to 11 a.m.
Evenings: 5 p.m. to 6 p.m.
Pool hours: 11 a.m. to 7 p.m.

Cost: Swim lesson fees are due prior to the start of the first class (no exceptions).

Group lessons: $40 for eight half-hour* lessons.
*Advanced levels (IV, V, VI, VII) last for 50 minutes.

Private lessons: $18 per lesson for four half-hour lessons (purchased at once). $20 per single lesson.

Refund policy: A full refund may be obtained if the class has not started and 48 hours?’ notice is given. Later than 48 hours prior to the first class or after taking some classes, a 20 percent processing fee will be assessed. For more information, please call the Carousel office at 303/422-7114.

Class size: 3-4 years and 5-6 years minimum of three students, maximum of six.
7+ years minimum of three students, maximum of eight.

More classes will be added if demand requires it.

1. Team swim suit swap day, June 7, 12 noon at the pool.

Bring your old team suit (black Nike boxers or Speedo for boys, black one piece for the girls) and trade with others! Old flippers too!

2. Swim team starts June 8!

7:45 to 9:30 a.m. - older kids with previous experience

8:30 to 9:30 a.m. - younger kids who need help (8 years and younger/depends on swimming ability)

3. More swim team . . .

Please note that the first week of swim team practice is free so you can be sure that your kids want to participate. After the first week, the cost is $75 per child.

4. Garage Sale

Swim team members can bring an item to Debbie Weeter?’s house on May 13. All proceeds of the sale go to the Swim Team.

The lifeguard has total authority with regard to persons using the pool and is to be treated respectfully at all times.

PLEASE refer to the Rules and Regulations on page 10 of your Heritage West Handbook. Additionally, NO DIAPERS are allowed in the pool. All small children must wear rubber pants.
