HC HOA where are we?

Hi, Timberstone wants to hire a management company at our expense to receive our assessments and pay expenses. That will perhaps serve our Covenant, but should not be at our expense. We few homeowners who have paid should have our funds saved until turnover of the community. All expenses should be paid by Timberstone, the HOA Board, because they do not pay their  assessments for vacant lots as stated in the Covenant. In fairness and in line with logic and law, Timberstone must abide by the articles of the Covenant jaust as we do. They are hiring a management company to serve the Covenant to comply with their obligation because we complained. They must not use our money to fund their obligations.

Steve do you know anything more about the vacant lot taxes?  I assume Timberstone are letting vacant lot taxes go and only keeping 1 or 2 spec homes available on each of their subdivisions to reduce expenses. I assume they will all be bank owned by December. They will then buy back lots from bank as demand warrants? Is this your thoughts as well?

 

Any word if the new HOA will be able to take action on our most infamous lawn scoflaw?

Joe, Not sure if management company has been contracted. Any action by them to remedy violations cost money so don't expect a lot of action. I did hear that Mohamed is out of the country and that he may be ill. Apparently someone stays there on and off. Just what I heard. The tax has not been paid and probably won't until the eleventh hour. The penalty is 1 1/2 % and the money probably sits somewhere invested at a higher rate of return. Timberstone only owns 5 lots at the most on the inside of the loop. The rest is owned by Westport and a bank. Timberstone has been negotiating with another builder to fill vacant lots. If you look at all the other Timberstone locations, you can see we are the most reasonably priced and the smallest development with fewest perks. Obviously the attention will be placed at the more valuable properties. Our neighbor Mr. Torres is meeting with some folks from the County to see what our rights and legal course of action may be to protect ourselves. I'm thinking a retainer to a lawyer with the hope of pay back from assessments would be a start.
