TMMC Directs Board at Annual Meeting-No Plan for ROOFS! LAWSUIT
Dear Highline Meadows Community Residents,
We attended the Annual Meeting last Week at the Buck Center in Littleton.
I was not impressed with the Board of Directors directed by Denise Haas and surrounded by the Lawyers of TMMC and the association. Denise did not really confront the real issue which is the roofs! I had to spell it out for her and the Board of Directors what the real issues is- "THE ROOFS". I sensed that our community does not understand we need to go into "Emergency Mode" and tried to use the "Full circle analogy" that shows when it rains the roof leaks and then the ceiling is damaged along with the walls and that causes Asbestos to be disturbed and requires Expensive Abatement.Which is cheaper and healthier for our community here at Highline Meadows?
We must cut costs of this inflated Budget significantly and then put that saved money into a separate account and get a loan to replace the roofs. At the very least, lets restore them at 14K each. We can get another 10 years out of them and then save the money we need. WE must ACT now before this Winter which has been showed to be one of the wetness on record. Can we make it through the Winter of 2008?
At the meeting, TMMC did comment that people contacting government agencies have cost the complex plenty of money but you cant find it in the budget. As a matter of fact, the Budget was presented as a split value $ for each six months leading up Dec from June and then after for 2008. Very confusing... unless you had a "BIG" calculator at the meeting. Therefore the numbers did not state the total amount for the Fiscal year since they are going to a Calendar year now. Also, there appears to be many discrepancies from this released budget as compared to what was released on Condo Certs for the month ending April 2008.
How these people TMMC and the Board of Directors went through 907K worth of money is beyond us and we still really don't know what the insurance money of 174K is for. We know that the aluminum wiring in the town homes has coverage with Lloyd's of London and she stated that TMMC and the Board have E&D insurance. She also explained that Asbestos' and Roof leaks were not covered by any insurance policy.
Why is the Aluminum wire issues always Tabled at the Board of Directors meetings. We need to get this fixed Now! WE then can reduce insurance cost.
Some highlights included the President of 10 years Tom Steinhauser stepping down along with the Vice President Dan Morgenthaler, although Denise spoke for most all of the meeting and is clearly in charge of this Board of Directors and our Future here at Highline Meadows.
Her View of our future was not so Bright as she stated that there are 151 people that have not paid there dues and that there is 165K uncollected. Although, when I asked where in budget this was, she said I did not understand how the budget worked and that it was not in the Budget and further did not offer any other explanation.
Most people were unaware of Asbestos' in there units and were surprised that my unit contained 15% asbestos in the ceiling. Of course, though, now I think I will never see a new Roof on my Building because it appears that we are over 40K in debt as a complex and not paying some of our contractors. We cant get a loan because our money has been Mismanaged by the TMMC Directed Board of Directors.
They spent over 7K in Drywall in the last year! They spend 25K in Lift Station Pumps. Over 2K for a Cell Phone... The spending never stops as all we see are Garbage Dumpster building overhauls and "Poop" Stations. Wake up people!!! The roofs are the big issue and we need to ACT NOW!
If these people could just take a look at "cutting cost" but it appears that the Board of Directors is being controlled by TMMC and and the only way to fix our situation hear at Highline Meadows is to go into receivership and figure out where all the money is going and fix the roofs. Why would the Treasurer say the "Pool" is more important then the roofs...This Board has lost there direction!
WE NEED to Cut cost Now! We cannot afford to pay two Maintenance personnel high priced managers salaries, pay a management company in Castle Rock a mint and continue to Pay out work out to Licensed, bonded and insured Contractors.
It is very unfortunate that even a loud plead to go into "Emergency Mode" to the Board of Directors for cutting costs and fixing the roofs has come on "deaf ears" and that they are plainly not interested in fixing the problems but to continue Tabling them at there meetings.
Over 60 people were represented by Proxy which does not come close to the 151 people required to make the change and it appears that the TMMC Directed Board of Directors still has control of this community and has full rights of Quorum. They will make the decisions... not us!
It would appear that we all need discuss a full complex class action suite. Many people are interested in the idea based on the Violations of the TMMC Directed Board of Directors not following the Declaration and putting this community in Jeopardy and allowing it to fall apart along with letting the roofs get so bad. The Board of Directors has been found to be incompetent and have mislead this community. It is time for the community to take control of the situation.
