Liens one way to collect --

One way HOAs can collect outstanding dues is to file liens against the property. MOST Deed Conditions, Covenents and Restrictions (or Deed Restrictions) OR HOA By-Laws allow for penalties to be added as well. Simply follow a standard format for recording the outstanding assessment fees, get it notarized, and send file it with the Jefferson County Clerks Office in the Deeds room.

Once the lien is filed, the homeowner will be required to satisfy the lien before he or she can sell their home and often (as banks prefer clear titles) before they can refinance, take out an equity line of credit, or add a second mortgage. A lien can also impact their credit score.

Not sure if you guys already do that, but trust me, it works.
