It looks like resigning from the Board of Directors got that SPECIAL MEETING after all?
I guess you all have your letter about turning the Association over to the homeowners October 3, 2006. I have written Becky Cruise asking her about some points that is made in the letter. More to the point about the sheet that has the duties of each Board Member.This sheet has the duties of the Officers not the Board of Directors.I also told her that I could only assume that this SPECIAL MEETING was for the homeowners to elect their Board of Directors. The first step in taking control of this association is to elect Board of Directors. Second Step is the Board of Directors APPOINTS the Officers. The homeowners don't elect the Officers.
I also ask her about this quorum that is required to pass control of the HOA? I ask her to point me to which Article in the Declaration I could find this quorum in?
The only thing I can find in the Declaration is that the Association should be free of all liens, ect. when handed over to the homeowners. Which should have been in 2001 when two third of the lots were sold.
Another thing of interest is the Architectural Control part.This part the developer has control of until it is done developing. Is the developer going to dump all those Architectural Control violations on the Association to cleanup? The Association has already paid for this cleanup.
