Okay, so I found the CC&R's on Oasis' website, but correct me if I am wrong... isn't part of what we pay for in the HOA for them to understand which regs are out of date and to put these laws on the agenda to be updated? In other words, is someone responsible for keeping these regs up to date and bringing it to the attention of the homeowners (in a meeting or other written forum) so that we know we need to vote on it?

Again, can someone explain what the heck is the real issue with the erosion? What is the problem? All I see is the lack of rocks in common areas to begin with. Is the drainage issue from when it rains and the greenbelts fill up? Heck if that's part of the problem, I can tell you that's just Arizona dirt! It's made of clay.

I am flabbergasted that this is even part of a topic to discuss and worry about when it was previously said that the notices would not be mailed because it was too expensive. Hmmm...... maybe there's a reason that people want new board members....

Finally, can someone clarify for me if the homeowners have a say in deciding on a new management company? This process seemed a little too wierd picking Oasis.  

I might not be the correct person to answer all your questions but I will give it my best shot.  In order to "update" the CC&R's there needs to be, Castlegate thought it was 50% but I think it was 2/3's in favor vote from the community.  Even at 50% it would be very hard since even when mailers are sent out (doubtfull from either of our management companys) and received, they must be returned with a vote.  I don't think the people take the time to do this.  One would need to go house to house knocking on doors, explaining what needs to be done and ask right there for the ballot, I think that would be the only way to achieve the 50% or 2/3's vote needed.

The erosion problem is real.  There is dirt that has been washed away from under sidewalks for several feet, the rocks that were put in some wash areas were the wrong type of rock (round river rock rather than angled rip rap), when it rains hard the rock just rolls down the slope and ends up at the bottom, this results in washing soil from the sides of the wash.  There are several areas that water stands for many days after a rain, many = over 4 days resulting in mosquitoes and unsafe water.  Sounds like quite a few dry wells are needed to resolve the issue.  There are some areas that soil has washed down the slopes into wash areas, the soil just needs to be gathered up and put back in the little stream looking areas. My personal feeling is that I feel this should be covered under our landscaping contract, not sure if this is or not.

As for the Board changing out the management company without asking the homeowners which company they would like to choose, yes the Board has that right.  It is in the CC&R's I believe.  However, the homeowners do have a right to change out the Board memebers, personally one reason why I want to recall two Board members that like making all the decisions.

So if you have an extra hour or two before the next meeting, let me know and I can send you the petition so that you could ask your neighbors to sign.
