I attended an HOA meeting and asked about the rotting fences along the golf course and was promptly told this was between the home owner and American golf, BUT it was from the HOA I received a letter requireing me to paint the fence, this letter should of come from American golf, not the HOA, after all as they stated it was not there problem.

Know this can be a little confusing.

The CC&R's and Association Rules state that maintenance of the golf course fences is the responsibility of the homeowner. Hence the letter from the HOA.

Several homeowners have complained that the cause of the rust on their fences is the spray from the golf course irrigation. HOA Members have been advised that the HOA has no authority over the golf course so if the homeowner wishes to pursue the spray matter it needs to be taken up with the golf course management.

While there are many advantages of living on the golf course, there are also downsides. Errant golf balls and irrigation overspray are just 2 examples.

I would think the HOA would go to bat for all the home owners who have had there homes damaged BUT, they stick there heads in the sand and hope this matter goes away, there are a lot of angry people who are going to pay $1000 plus to have there fences replaced.

Well Traxx here is the way I would fix it. 1. Send a certified letter to the Golf Course owners letting them know you intend to sue them for the cost of fixing the fence if they don't pay you for it. 2. If the letter is not heeded then file a small claims court suit against them for the cost of fixing the fence. The cost is about $36 dollars which can be recouped by winning the case. Take pictures and an estimate to court with you and win a judgment against them and collect your winnings. It is that easy and you can tell all your friends about how you stuck it to the man for $1000 dollars. And by the way you don't even need to credit me with the advice either, it's free.
