LAS PALOMAS HOA BOARD MEETING
MAY 18, 2005
The meeting was called to order by President, Ken Dry. A quorum was established with four of the five board members present. Jerry Ahler was out because of surgery.

PROPERTY MANAGER?’S REPORT
1. Two homes for sale?—Lots 75 and 106. One home is rented?—Lot 23
2. A power washer has been purchased to clean walls and buildings and prepare the surfaces for paint.
3. Jack Richards, one of our front gate attendants, is moving away. Jack has been an excellent attendant and we are sorry to see him go. We have hired a replacement who will start this weekend?—Betty Colton.
4. Two large ficus trees in the pool area have been trimmed to reduce the debris on neighboring roofs and backyards.
5. The cause of a leak making mud at the south lake path has been located and fixed. The mud will dry up in a couple of days.
HOMEOWNER REQUESTS
1. Mr. Kudla, Lot 115, has indicated that he would like to buy the north tennis court area to build a home. (See Letter) The HOA has no plans to sell this property and will proceed with repair of the court.
2. Homeowners at Lots 79 and 80 have requested that the board approve the removal of a tree between the two lots which has caused both lots many problems. The two parties will remove the tree and replace it with something more appropriate at their own expense. The board unanimously approved the request with the condition that a replacement tree has to come from an approved list of trees which will be provided by Bob Wallace.
COMMITTEE REPORTS
LANDSCAPE AND GROUNDS
Landscape and Grounds committee met on May 12th at the fire pit area. Members of this committee are: Barbara Goldfarb, Jean Roberts, Patti Wilson, Marian Cocanour, Bill Moore, and Georgia Greene. Mike Frain, chairman, presented the board with minutes from that meeting. Ken stated that all we really need are recommendations for the board to consider.
Thus, the first recommendation is that the fire pit area needs attention?—bushes and trees need trimming, and certain plants should be removed and possibly replanted elsewhere. The whole area should have a lighter feeling. More stones are needed to cover the dirt. The board approved this suggestion.
The second one was the suggestion, made by Ken Dry, that the HOA purchase a new propane grill to replace the old, small grills. The committee suggested that homeowners will be expected to pay a small fee for gas and cleanup if they use the area. The majority of the board felt that we should start out letting people use the area without a fee, with the understanding they would clean it up after use. This area would have to be reserved so we can keep track of who is using it. A fee will be instituted if people do not clean it up. The board thus resolved, that we would purchase an industrial type propane grill that could be placed in a masonry base, after looking at the budget to see what kind of monies are available.
This committee also recommended that the two pool areas need more tables and chairs?—six of each was decided. The board approved this suggestion.
RULES AND REGULATIONS
David Kelsey, chairman of the rules and regulations committee and Ken Dry met with Lynn Krupnik, an attorney who specializes in HOA matters. They discussed with her the enforcement of fines, CC&R?’S, conflicts between homeowners, etc.. Her conclusions regarding these issues are as follows:
1. The attorney feels that our CC&R?”S are archaic because of the laws that have been passed in the Arizona Legislature in the past few years regarding HOAS?’.
2. Our rules and regulations should be folded into the CC&R?’S so they are easier to enforce.
3. Arizona has procedures in place to enforce fines?—case law.
4. CC&R?’S should conform to state law, which ours do not, so should be re-written.
5. There are very few HOAS who take responsibility for painting homeowners?’ residences. This needs to be changed.
6. Suggest that the Las Palomas CC&R?’S be revised and a draft completed.
The board unanimously agreed that our current CC&R?’S are antiquated and need to be revised, updated, and brought up to state code. The board gave Bob Wallace the approval to contact Ms. Krupnik and start the revision. A draft will be given to all homeowners to review, make comments on changes, and give suggestions. After that, a vote will need to be taken to approve the new CC&R?’S?—a seventy-five per cent approval from the homeowners.
Currently, violators of rules and regulations are dealt with on a one-to-one basis, in which Bob Wallace talks with the homeowner. This seems to work most of the time.
SOCIAL COMMITTEE
Sherry Mischel gave a report on the last meeting of the social committee. The group has set up a series of social events that goes through the spring of 2005.

To fund these social events, the committee submitted a budget proposal for the board?’s consideration. The budget also includes welcome gifts for new residents along with a welcome letter.
This summer, at the end of each month, a cocktail party or brunch, or dinner will be set up for those residents who would like to get together and socialize. Notice of these events will be displayed on the board at the front gate. Please watch for the first one toward the end of June.
The meeting was adjourned at approximately 7:30pm. The next meeting is scheduled for Wednesday, June 15, 2005.
RESIDENTS?’ FORUM
1. Mr. and Mrs. Galat wanted to know the status of the North Tennis Court?—It will be cleaned, patched and sealed for about $10,000 plus a new fence.
2. Larry Seidman is concerned about the pruning of vegetation that backs up to his property. He was assured that it would fill out.
3. Barbara Kelsey is concerned about the cement areas around the edge of the pool. There are many cracks and broken areas. These will be repaired.
4. Sherry Mischel requested a clarification of the removal of the locks from the pool/pond fence. Ken stated that state code only requires a self-latching gate, high enough to be out of reach of small children. The locks were also taken out as a convenience to the residents.
