Parking Pads / Driveways / Sidewalks

Parking pads have to meet certain size standards, and must be installed behind sidewalks and out of the right of way.  Even where there are no sidewalks you should not install a pad in the right of way.    Driveways must be as perpendicular as possible to the streets where they cross sidewalks and right of ways.   Municode 12.206 and 10.907 spell out about driveways for single residential homes, and parking pads.  Remember parking is permissible on almost all our streets in Madison Park and is looked at as a form of traffic calming.  To park on the street you simply need to make sure all 4 wheels are on the pavement.  Having one or two wheels beyond the curb is considered parking on the lawn.  311 will handle parking on the lawn. Inspectors can fine you $25.00 each time they see a vehicle on lawn and this is per vehicle.  Even worse code enforcement can tow you after 3 tickets for lawn parking.   .

Driveways and parking pads shall have a minimum length of 20 feet, measured from the back of the sidewalk, or back of the right-of-way, whichever is greater. Driveways can be installed across the required setback and yard areas, and shall be as nearly perpendicular to the street right-of-way as possible. Driveways and parking pads shall be improved.* Individual driveways or shared driveways shall have a maximum width at any one point of 20 feet. Driveways for individual garages may be used to meet a portion of the required parking if they are a maximum of 20 feet wide and at least 20 feet in length.

Parking is allowed in the setback, but vehicles shall not block the sidewalk and shall be parked completed only on improved surfaces.* No parking is permitted in the right-of-way, except for parking as approved by CDOT.

* For the purposes of this section, "improved" means surfaced with concrete, asphalt, gravel, or any other material commonly used for the parking of vehicles, but not including grass or dirt.

 No surface parking or maneuvering space shall be permitted within any required or established setback, and no surface parking or maneuvering space is allowed between the permitted use and the required setback, except that:

1.Driveways providing access to the parking area may be installed. It is the intent that these driveways be as nearly perpendicular to the street right-of-way as possible to minimize intrusion into the landscaped area, and for pedestrian safety;

2.Driveways providing access to structured parking facilities are permitted between the rail corridor setback and the building. However, the length of the driveway shall not exceed fifty (50) percent of the length of the property line along the rail corridor.

All recessed on-street parking shall comply withCharlotte's Urban Street Design Guidelines, when adopted.
