MAGNOLIA FOREST FAQs

1.) Where can I find architectural rules and restrictions for Magnolia Forest HOA? 

       Magnolia Forest Home Owners Association Declaration of Convents, Conditions, Restrictions contains all the regulations concerning Building guidelines and Post Construction additions, removal and changes to the property. Always check this document when you want to make any changes, additions or removals on your property or house. HOA approval may be require as well as permits from Gadsden County. If you are not sure, contact the HOA for clarity. Violations of these HOA regulations can result is a substantial fine of $1000 - $1500 or more. 2). Can I build a house without the approval of the HOA? 

       NO. The Declaration of Convents, Conditions, Restrictions contains an Architectural Review Check List and the description of the building requirements and restrictions for Magnolia Forest.  Building permits and plans for the home must be approved by the Architectural Control Committee (ACC) before any clearing of the land. These can be sent to Magnolia Forest HOA, PO Box 6, Quincy, Fl 32353

3). How do I submit my request and plans to the HOA for changes, additions or removals? 

      YES. In the Magnolia Forest Home Owners Association Declaration of Convents, Conditions, Restrictions there is Post Construction Request Form. Fill in this form; provide a site diagram showing where the changes or additions are located; include pictures and diagrams of 1) structures with specifications and permits or areas to be cleared (See # 4 and #5 below); and any other information requested to the HOA Architectural Committee (ACC) for review. Depending on the request, further information may be required, or you may need to submit a Gadsden County Permit.  Send this information to Magnolia Forest HOA, PO Box 6, Quincy, Fl 32353. Not submitting this form prior to making the changes, additions, or removals is a violation of the HOA Declaration and subject to a $1000 - $1500 fine. 

 

4). Are their limitations and regulations for CLEARING the property? 

       YES. Clearing and the removal of trees can require submission of a Post Construction Request Form  ( See # 3 above).   According to the HOA Declaration of Covenants, Conditions, Restriction section 6.7 Clearing, you were permitted to clear the area 20 feet around your house without approval of the HOA.  Any clearing and removing of trees beyond 20 feet is prohibited and must be requested using the Post Construction Request Form and approved by the Architectural Committee. 

       The HOA Declaration states that live trees of 4 inches and more in diameter cannot be removed without approval of the ACC.  This 4 inch limit applies mainly to non - pine trees. The Gadsden Count Land Development Code, Chapter 5, Subsection 5404, protects non-pine trees of 20 inches and more in diameter cannot be removed without a permit. The Gadsden County Planning Department states that HOA Tree Removal and Clearing policies can be more restrictive than the County Code. 

       The HOA declaration, section 6.7, also states that a vegetation visible buffer be maintained at the sides and rear of the lots. The Gadsden County Land Development Code stipulates a 10 foot buffer between the sides and rear of adjacent properties. 

 

5). Do I need HOA approval to add a SHED or STORAGE UNIT or additional GARAGE? 

       Yes. You must complete the Post Construction Request Form and provide a site diagram showing where the structure is located on the property; pictures and diagrams of the structure with specifications and Gadsden County permits.  Send this information to Magnolia Forest HOA, PO Box 6, Quincy, Fl 32353 for review and approval by the ACC.

6). Are FENCES permitted? 

       Nofences or walls are permitted in the front of the residency.  Only natural plant type fencing is permitted around the perimeter of the property. Material type fences or walls of any kind are not permitted. 

Limited fencing within the property lines may be permitted for dog cages, gardens, child play area, and a swimming pool barrier. These enclosed areas must be of minimal visibility from the street. 

       For all fences, the Post Construction Request Form (See # 3 above)must be completed; a site diagram showing where the fence is located on the property; and pictures and diagrams of the fence with specifications must be provided. All fences must be specifically approved by the ACC before installation. 

 

7.) Who is responsible for Landscape Maintenance and Trash/Garbage Removal 

        The Owner/Occupant of the property is responsible for maintaining the landscape of the property – grass, scrubs, vegetation, trees, and flowers. Garbage and trash cans must be stored in the back or side of the house and not be visible from the street. HOA contracts for lawn services along the roads and sidewalks. 

Waste Pro handles the garbage collection in this subdivision. For the removal of Bulk Waste, Yard Debris, and Hazardous Wastes see below: 

  • Bulk waste consists of household goods such as couches, chairs, mattresses, tables, and appliances. These will be handled on an on call basis by Gadsden County. To schedule a pickup please call our office at (850) 606-1899 to set up collection of bulk items. 
  • Yard debris is picked up one (1) time per week (currently on Friday).  Yard debris such as limbs can be placed in piles no larger the 6 ft. in length, 4 ft. high, and 4 ft. wide.  Loose yard debris such as grass clippings or leaves can be placed in customer provided reusable containers, paper bags or plastic bags. Please do not place yard debris for collection next to a mailbox, utility pole or close to a fence.
  • Household Hazardous Waste is accepted on Thursdays from 9:00 a.m. - 1:00 p.m. at 

The Public Works Department located at 1284 High Bridge Road in Quincy, FL.  For questions regarding Household Hazardous Waste, call (850) 627-5334 or 510-7784.

Accepted items include: Used Oil; Antifreeze; Batteries; Used Tires; Gas; Fluorescent Lamps; Mercury Devices; Paint; Pesticides, TVs, computer monitors, printers, scanners, calculators, phones, answering machines, digital/video cameras, VCRs, DVD players, MP3 and CD players 

8).  Can SIGNS be placed on my property? 

         Only professionally constructed For Sale signs can be displayed within the boundary of your property. For Sale signs must be mounted on a free-standing post or sign holder and must not exceed 5 square feet.  Pollical, advertising, business, event announcements or similar signage is prohibited. Signs can be displayed at the entrances of Magnolia Forest along Highway 90 and at the junction of Selman and Peachtree roads.  The HOA reserves the right to remove signs at the entrances after an appropriate time period. 

9).  What are the HOA Dues? 

         The Home Owners Association (HOA) dues for 2018 remain at $240 per year. Of this amount, $65 is set aside in a separate account for the draining of your septic tank every 5 years. Your dues must be paid each year to have your septic tank serviced. If you just own property with no house or septic tank then the HOA dues are $175

       You will be reminded each year about the amount of payment that is due by March 31. If  you fail to make the March 31 due date, your account will be considered as delinquent and you will be charged a  late fee of $25. On July 1 liens will be processed  against your property which will include a $100 HOA fine for non-payment. 

Summary

a late fee of $25 will be charged to you  

  1. HOA non-payment liens are processed July 1. 
  2. HOA non-payment fine of $100 added to lien amount.

10). How do I get my Septic tank cleaned? 

          Septic tanks are scheduled to pumped out every five years. There may be issues that may require the homeowner to have their septic tank pumped out prior to that time period or multiple times within the five-year period, but it is not the HOA's responsibility to have multiple pump outs with the scheduled time period. Additional pump outs could be due to a plumbing issue or roots growing causing the septic tank to back up or fill up faster than normal. These type situations are the homeowner's responsibility. We collect $65 each year as part of your HOA dues for septic tank cleaning. During the five-year period, the homeowner has paid $325 for the septic tank service. That covers a single pump out per homeowner. If the HOA dues are delinquent, the cost a septic tank clean out is the responsibility of the property owner.

 

11). Is there an ANNUAL MEETING of the HOA membership? 

         Each year there is an annual meeting usually the week after Christmas. It commonly runs from 7:00 – 9:00 pm. The meeting agenda includes 

         Secretary Report and Minutes 

         Treasure’s Report

         Elections of Officers  

         Architectural Control Report

         Neighborhood Crime Watch Report 

         Various Business issues 

         Questions and concerns of the membership 

12). Can any anyone attend the business meetings?

          Because these meeting are held in Board Member homes, attendance must be limited to individuals who are on the meeting agenda or by invitation.
