Dear Neighbors:
As you may already be aware, we are running out of drinking water. The City of Tampa has enacted an emergency ban on automatic outdoor irrigation as of April 3rd. Please see the attached document. Our sprinkler systems will be shut down; however, hand watering of turf will be allowed one day per week between 6 PM and 8 AM -- even-numbered addresses Tuesdays; odd-numbered addresses Sundays. We must comply with the ban and encourage you to hand water during the appointed times.
We know this is an inconvenience and we thank you all for your cooperation in preserving our lawns. What happens if your lawn dies due to lack of irrigation? According to the Declaration of Covenants, Article 12.9.5:
“All Association-maintained grass and landscaping that die shall be replaced by the Association and charged to the Owners as a Common Expense; provided, however, that any grass or landscaping replacements on a Lot resulting from freeze damage or failure to irrigate the grass and landscaping shall be undertaken by the Association and charged to the Owner thereof as a Specific Assessment”. In other words, the Association will replace the grass at the owners’ expense.
