Changing Deed Restrictions

Would you like to petition the maintenence corporation and the ARC committee to change our deed restrictions on the size of sheds, and any other unreasonable restriction that you think need to be modified. These changes will benefit our community and allow us to have a say in what happens in our community. As it stands now the ARC committee is determining what is best for our community. We are all a community not just a selected few. Yes we opted for a board to mediate the guide lines of our community. But, I think that the community needs to have more of a say regarding the property in which we have purchased. The ARC committee is quick to send out violation letters but do not want to inform the community that deed restrictions can be modified to suit the community.

If you feel as strongly about the deed restrictions as I do. Please respond. There is a board meeting on the 20th of February at 6:00pm at New Castle Middle School.
Board Meetings and Deed Restrict

Bayview Manor II Community - the process to change or implement a new deed restriction starts with submitting your request to the ARC Committee. No petition with signatures is required. The ARC Committee then presents this request to the Committee and then to the board. If the board votes to move forward, it is put to a community vote - at the annual community meeting. There is also a process to submit the changes to the county and then to get the county to make the changes. There are fees associated with making such changes.

The ARC Committee does not determine what is best for the community. They simply enforce the deed restrictions that were agreed on by all homeowners when they bought into this community.

It is the board's responsibility to see that the ARC Committee enforces the deed restrictions. These are not merely guidelines, they are true restrictions.

There is a board meeting on 2/20, however, that meeting is not open to the public. The board is required to have a community meeting once a year, which is open to the community. However, there are actually two meetings a year. the next one will be held in the April/May timeframe. If a community member has an issue that they want the board to review, they should present it to a board member to be added to the next meeting's agenda. The community member can request to attend the meeting that the issue is discussed.
