A Refresher...

All homeowners received copies of the NWHA deed restrictions when they moved into this neighborhood. But, how familiar are you with the contents of this document?

Below is a summary of our deed restrictions. It is important that each homeowner be familiar with the DOs and DON?’Ts of our neighborhood.

 All property shall be known and described as residential property ?… one detached, single-family dwelling not to exceed 2 ?½ stories in height and a two- or three-car garage, to be attached and part of the main structure.

 All houses shall have at least 1 ?½ inside baths and 1,800 [livable] sq. ft.

 Structures shall not be erected nearer than (1) 25 ft. to front lot line, (2) 10 ft. to rear lot line, (3) 7 ?½ ft. to side lot lines, and (4) 25 ft. to any side street. Structures shall not exceed 25 ft. in height.

 No tents, shacks, garages, barns or other outbuildings shall be erected and used temporarily or permanently as a residence or for any other purpose.

 No trailer shall be parked permanently or temporarily as a residence on any lot.

 No animals, livestock or poultry shall be raised, bred or kept on any lot, except cats, dogs and other small household pets.

 No advertising signs shall be displayed except for ?“For Sale?” signs, which may be displayed inside a window of a house.

 No vehicle shall be parked on any part of a property except on paved streets and paved driveways.

 No trailers or commercial vehicles, including mobile homes and RV?’s, may be parked in the subdivision.

 Boats and/or trailers may be parked inside garages and concealed from public view.

 Trash, garbage and other waste shall be kept in sanitary containers, properly concealed from public view.

 These covenants and restrictions are to run with the land and shall be binding on all parties until January 1, 2020, after which said covenants shall be automatically extended for successive periods of ten (10) years unless an instrument signed by a majority of the lot owners has been recorded, agreeing to changing, altering or rescinding said cove-nants in whole or in part.

 If any person violates, or attempts to violate, any covenant or restric-tion before January 1, 2020, or any written extension, it shall be lawful for any other person owning any part or parcel of the described land to prosecute any proceeding against the person violating such covenant or restriction, either to prevent him from so doing or to recover damages.

 All dwellings shall be constructed with concrete driveways, solid sodded front lawns, sidewalks the width of the lot along the edge or all road right-of-ways, and a basic shrubbery planting across the front of the house.

 Written approval by the developer must be obtained for (1) grades or elevations of any portion of any lot, (2) removal or alteration of curbs, drainage structures, water lines or sewer lines, and (3) fences. No fence, wall or hedge will be permitted on any lot in front of the front building line.

 No clothes drying poles or lines shall be erected or used on the property in a way that is visible from the street.

 Owners of vacant lots agree to accept and promptly pay the monthly mowing charge for their lot, when billed.

 Houses built with CBS shall have a finished stucco coat exterior. No exterior imitation brick or stone will be allowed.

 The following shall not be visible from the street or from adjacent property - garbage or trash contain-ers, air conditioners, oil tanks, bottle gas tanks, soft water tanks, swimming pool filters and similar structures.

 No price signs are permitted.

 Each lot owner shall be responsible for maintaining the adequate flow of water within drainage routes within the lot.
