Letter concerning Violations

Dear Homeowner,

Over the last few months we have had violations of the Covenants, Conditions and Restrictions in which our efforts to resolve the violations are being ignored by the homeowners. As a result, the Board of Directors (BOD) has concluded that the lack of actions by the homeowners warrants imposing fines and/or placing liens against the member?’s homes as defined in the CC&R?’s.

The BOD has agreed that prior to imposing fines and placing liens, we will seek legal counsel to ensure we are meeting the intentions of the CC&Rs. Additionally, retaining an attorney will help us enforce the CC&Rs and guide us with issues that may arise in the future so that we may continue to maintain the integrity of our neighborhood.

At this time funding is available to retain an attorney and we do not believe we will need to increase dues. If it becomes necessary to settle a matter in court, we will then ask the court to impose fines sufficient to cover all legal and court costs by the homeowners who are in violation of the CC&Rs.
