Holiday has been such a great area to grow up in. Over the years I have seen many people come and go. I moved back into the area in 2000 hoping to raise my kids in the area. I've purchased a few homes, but it was never mentioned that we would be paying a fee for our community center, along with our streetlight and trash fees, so I paid little attention to the quarterly statement and always paid on time.
It was brought to my attention that in the billing statement a portion was directed towards the delapidated community center, and I began to question where the fees were going and why the fee was mandatory, not to mention I had never signed ANY documentation stating I was in a mandatory homeowners association or a deed restricted community. It was never mentioned at the time of our home(s) sale or purchase.
Through research I discovered we were never required to pay the fee as the Association membership is voluntary and the deed restrictions had long expired.
I submitted a termination of membership to the community association and received a letter stating the fees were voluntary. Over a year later I am receiving the 2nd notice threating to send "delinquent" accounts to collections and cut-off services (though all fees are paid up to date).
I am putting this post out to our community members who are in this situation, who are not paying the rediculous fees, and are ready to shut this operation down. Is it fair for us to continue to pay fees for other people to use our community center?
