IN RE: Liquor License Application N?° 10074631 - Produce City
5508 N. 43rd Avenue, Glendale
Applicant: Ben Jargis Safou

One of our members, Marilyn Ely, alerted us about the subject
application, which is a new one. It would appear that, once again, the
owner of a small grocery store wants to succeed, not by selling
groceries, but by selling wine and beer (Type 10).

As we have discussed at our meetings many times, our square mile and
adjacent areas are saturated with liquor-dispensing establishments. The
perfect example: There already are 24 liquor-dispensing establishments
within the one-mile radius of this location (see enclosed map and list of
locations). We certainly do not need another one.

Another concern is that Produce City is located diagonally across from
the school planned for construction in the empty lot just south of
Bethany Home Road on 43rd Avenue, Hi-Star Learning Center.

There are several issues in the application that are troubling. The
applicant was fined $3,000 for selling liquor to a minor; however, he
answered ''NO'' to question number 16 in the Questionnaire, ''Have you EVER
been convicted, fined... for violation of ANY law or ordinance...'' The
applicant has not listed the schools and churches that are near his
store, listing instead some that are quite distant. He left blank the
question as to whether he had attended a Department approved Liquor Law
Training Course within the last 5 years.

Consistent with our position vis ?¡ vis new liquor licenses, we should
like to generate as many letters as possible from our members and other
residents in opposition to this new liquor license application. Glendale
uses the same criterion as the State: one-mile radius. Therefore, most
of us are interested parties and our letters would be accepted by the
City of Glendale.

Letters should be addressed as follows:
City of Glendale
5850 West Glendale Avenue
Glendale, Arizona 85301
Attention: Mr. Michael Bailey, Regulatory and Communications Manager

Glendale only requests one original.

***The deadline date to send letters is October 1st. Time is of the
essence.***

If you need any further information or need typing services, please
contact me at any of the two phone numbers that appear below. Would you
also give me a copy of your letters so that I can reproduce them for our
Board members who may be addressing this issue before Glendale officials?
It would be important to state that several of our members have written
letters. The more, the better. We appreciate your speedy attention to
this matter.
