Rainwood Cove Neighbors

who upholds the deed restriction

Posted in: Timberwood Park
I would like to know who is responsible for making sure the deed restrictions are adhered to. Why are so many things let go that affect our neighborhood? why should some be allowed to get away with breaking or going against those deed restrictions at the expense of others rights?

I would think the TPPOA should be responsible for enforcing the deed restrictions in TWP. However, it is painfully obvious that they are not doing their job. This neighborhood is going to hell. I'm getting to the point that I want to sell and move to a better maintained neighborhood. It seems that many people take absolutely no pride in their homes. I am so sick of being chased by loose dogs when I walk my dog (on a lease of course). Not to mention all of the eye sores along the way such as: cars parked in the yard, trash in the yard, basically junk yards everywhere!!!! A couple of weeks ago I had to stop my car to get two small children out of the road playing unsupervised, one of which couldn't have been more than a year old and he was naked. As I was walking them to their door, their mother came out and started yelling at them. Wow, I really thoght I lived in a better neighborhood among better people, but I was wrong. I am so disgusted with TWP. Surly this isn't going to help our property values.

Anyone else had enough?

I believe you have multiple groups/agencies that you need to report to in order to get your issues resolved. First, call animal control/sheriffs office when you see loose dogs, they will be picked up, fined, & after certain # of violations, no longer allowed to have dogs. Second, CPS may need to be contacted about the children, Im a mom so I know that kids can get somewhere quick & the road is no exception- that does not make you a bad or dangerous parent... However, a normal reaction would be terror the kids are in the road + theres a car + a stranger = terror... Instead the reaction is yelling at the kids? Typically means deeper & worse situation than the one you thought was bad to begin with! Finally, the question I think you were actually looking for an answer to... YOU. Its the home owners that enforce deed restrictions, you make up the HOA... thats why you pay dues, Complain to the higher up commitee members of your HOA and they will post notices & if violations not remedied, take them to court.... Remember, the squeaky wheel gets the oil & you have to complain typically in writing & the president/vp/etc of the HOA will take action for you, thats why they hold those positions... to be a voice to the multiple Home owners- the only reason they are there is to do what ya'll want... otherwise, they have no point, so put them to work... I assure you they will mail out the bills and over due letters to you so they can make there money but will avoid violations because it makes work for them.... if you complain, they have no choice but to proceed. Good Luck, I look forward to an update :)
