Should there be an exception for a place that was negatively affected due to a hindered service of a company that serviced the whole community?


Hurricane Irma stormed through and ruined may roofs.  A company was hired to replace the roofs with shingles, skylights, etc.  However, in a state where it is notorious for rain, tropical storms and hurricanes, no gutters and downspouts were installed.  This was due to the client who hired the company.


Now, when there is rain or any type of downpour, the water flows in the valley of the roof and floods the backyard near the foundation of the building.  Whether there is grass or a large collection egg rocks spread along the way, the water collects highly risking damage to the foundation of the building.
