Fox Run Board of Directors Meeting
February 17, 1999

Meeting called to order at 3:40 PM.
The letter of issues was provided to Hammersmith management for review prior to the Board of Directors meeting. Mr. Gassner began the meeting by addressing each issue that we had listed in our letter.
Issue #1 - Drainage: Mr. Gassner (repeatedly) stated that it is not his responsibility as the developer to solve any of the drainage issues within the development. He stated that as a developer he submitted an overall drainage plan to the county, this plan was approved by the county and that it is the responsibility of each homebuilder and the county to implement and enforce the necessary steps to deal with the drainage issues.
Mr. Gassner did identify two drainage issues that he said he would take actions to correct, but he again emphasized that it is not his responsibility. These specific drainage areas are on Longmeadow Lane (near Timberside) and on Dearcross. Mr. Gassner did specify that he plans to resolve these drainage issues by April 1999, as weather permits.
The disagreement as to who's responsibility the drainage issues are, was discussed and Mr. Gassner proposed to arrange a meeting with the county, homeowners, homebuilders, and The Board of Directors/Developer, to identify who is ultimately responsible for drainage issues within the development. Barbara Langlois and I (along with two or three other homeowners, TBD) offered to be present to represent the interests of the homeowners. Any homeowners interested

Issue #2 - Trail System: Mr. Gassner stated that the trails are being started and that he could just install all the trails over homeowners existing landscaping or work with each individual homeowner to cooperatively install the trails. He stated that the progress would be slow and done by one individual worker and work would be done on
weekends to allow time to work with homeowners. If any homeowner does not want trails installed on their lot, the trail worker would move onto the next location.
Issue #3 - Entrance Lighting: Mr. Gassner indicated that he is not obligated to install any additional entrance lighting. He installed the limited lighting to the first development sign on Baptist Road. He may install lighting at other entrance locations.
Issue #4 - Cul-de-Sac Snow Removal: Mr. Gassner explained the priority system used by the county to plow roads and indicated that Cul-de-sacs are last on the list. I pointed out that we understand that system, but would like to see some action to at least plow cul-de-sacs for heavy snow. Nothing is being done to plow these streets and some streets (Timberside for example) turn to ice and stay that way for several days if not plowed. Mr. Gassner said he would
remind the county of their commitment to plow our cul-de-sacs.
Issue #5 - Quarterly HOA Meeting: Mr. Gassner said he has no intention to have quarterly homeowner meetings. He indicated that homeowners are welcome to meet on their own whenever they would like.
Issue #6 - Advisory/Transition Committee: It was noted that only one homeowner (Me) volunteered for this committee from the last newsletter request for volunteers. For this reason, the Board of Directors has no plans to move forward to organize a Transition Committee.
Issue #7 - Monthly Newsletter: Mr. Gassner said that the
Communications Committee is now distributing newsletters and they can provide the information requested within the community. He does not plan to take any additional steps to provide homeowner communication on these issues.
