I had assumed that was the case, and that we do not have an Association that will handle the legal stuff. I remember when I bought back in '89 Briargate (the developer) took care of the covenant stuff and they were VERY good at enforcing the rules, much the same way other's do (Perigrine, Mtn. Shadows)now. You sure see a lot of stuff that are ''against the rules'' around the neighborhoods, such as weird house colors, trailers, boats, etc.. that are illegal in the covenants. I really don't care to go to court over this stuff, since the cases would drag-on forever since there would be so many.

Hate to see Briargate go the way of V7 or the ''south'' side of town, but I fear it is going that way.

We have tried to get a newsletter together with our own busy schedules and only have a few articles for it at present.

Covenant enforecement? We have a specific mention in our ByLaws that we are not a covenant enforcement association. This CAN be changed, but we have to have a vote of the majority of the homeowners in the area in order to do it. I am not clear on whether this applies to each individual filing or not--I think so.

In the meantime, you have the right to talk to any neighbor who, in your view, is not living according to the covenants that came with his deed. If he does not correct his infraction and abide by the covenants, he can be taken to small claims court by any other homeowner who feels that he is injured in some way.

Or, we can change the nature of our association by a vote and take action to correct the situation.
