AMENDMENT TO DECLARATIONS OF COVENANTS, CONDITIONS AND RESTRICTIONS OF ROLLING MEADOWS NO. ONE, TOWNHOUSE ADDITION

Know All Men By These Presents:

Whereas, on January 19, 1972, ATTACHED HOUSING, INC., a Texas Corporation, hereinafter referred to as “Declarant” caused to be filed in Volume 5175, Page 254 through 288 of the Deed Records of Tarrant County, Texas, Declarations of Covenants, Conditions and Restrictions covering the following described property owned by Declarant situated in Tarrant County, Texas and being more particularly described as follows:
A tract of land containing of 8.9 acres of land described as Tract A, Block 2, Rolling Meadows, the first installment of an addition to the City of Arlington, Tarrant County, Texas located east of Merrywood Place and south of Mayfield Road in Arlington, Tarrant County, Texas, and more particularly described as Rolling Meadows No. One, Townhouse Addition consisting of Lots 1 through 16, in Block 2A, Lots 1 through 34, in Block 2B, and Lots 1 through 28, in Block 2C, an addition to the City of Arlington, Tarrant County, Texas, according to a plat prepared by John R. Bell, Jr., Professional Engineer, License 874, State of Texas, dated July 1, 1971, and recorded in Book 388-70, at Page 23, of the Plat Records of Tarrant County, Texas;
Whereas, on August 6, 1973, Declarant caused to be replatted a portion of Lots 19 through 28, Block 2C, Rolling Meadows No. One, Townhouse Additions into Lots 1 through 8, Block A, Rolling Meadows Townhouse addition No. Two, according to plat prepared by Albert W. Rollings, Professional Engineer, License No. 13655, State of Texas, said plat being filed on August 14, 1973 and recorded in Volume 388-85, Page 45, of the Plat Records of Tarrant county, Texas; and
Whereas, Declarant has replatted Lots 7 and 8, block A of Rolling Meadows Townhouse Addition No. Two and Lots 17, 18 and a portion of 19, Block 2C of Rolling Meadows Addition No. One into Lots 7R, 8R, 9, 10, 11, 12, and 13, according to plat prepared by John R. Ball, Jr., Owner Engineer, dated November 1975, and
Whereas, Declarant and Rolling Meadows No. One, Townhouse Addition Association, Inc. desires to incorporate Lots 1, 2, 3, 4, 5, and 6, Block A, Rolling Meadows Townhouse Addition No. Two and Lots 7R, 8R, 9, 10, 11, 12 and 13 (being a replat of Lots 7 and 8, Block A and Lots 17, 18, and 19, Block 2C of Rolling Meadows Townhouse Addition No. One and No. Two) into Rolling Meadows No. One Townhouse Addition
Now, Therefore, in consideration of the premises and other valuable consideration, Declarant hereby declares that hereafter the following described properties shall be held, sold and conveyed subject to the Declarations of Covenants, Conditions and Restrictions filed by Declarant on January 19, 1972 and recorded in Volume 5175, Page 254 through 288 of the Deed Records of Tarrant County, Texas, to-wit:
Lots 1, 2, 3, 4, 5 and 6, Block A, Rolling Meadows Townhouse addition No. Two and Lots 7R, 8R, 9, 10, 11, 12, and 13 (a replat of Lots 7 and 8, Block A and of Lots 17, 18 and 19, Block 2C of Rolling Meadows Townhouse Addition No. One and No. Two according to a plat prepared by John R. Ball, Jr., Professional Engineer, License 874, State of Texas, dated November, 1975) an addition to the City of Arlington, Tarrant County, Texas.
Executed this 28 day of May, 1976, in Tarrant County, Texas.

AMENDMENT TO DECLARATIONS OF COVENANTS, CONDITIONS AND RESTRICTIONS OF ROLLING MEADOWS NO. ONE, TOWNHOUSE ADDITION
Revised from Covenants, Article IV, Section 9 – Insurance
Proof of insurance from each individual townhouse owner is due annually. The owner has thirty (30) days from written notice to return proof of insurance to the Association. Failure to do so will result in a fine of $5.00 per day for every day late. If proof of insurance is not provided within this time frame, the Association will automatically purchase insurance for the property and the premium will be billed to the owner. The premium will not include the interior contents of the townhouse.
Notice will be given to the owner that the insurance has been purchased for his property. If this premium is not paid within thirty (30) days, a lien will be automatically filed in small claims court on the property. The lien will be reversed at the owner’s expense. The owner will be responsible for all court cost incurred.

AMENDMENT NUMBER THREE TO THE
DECLARATIONS OF COVENANTS, CONDITIONS, & RESTRICTIONS OF THE ROLLING MEADOES NO. ONE, TOWNHOUSE ADDITION.
BALLOT VOTING. The system of proxy voting is hereby suspended due to past abuse and improprieties. All future voting on Association issues that requires the entire membership participation will use an official written ballot form. The ballot will be mailed to each owner. This ballot form will have all issues clearly stated with a check box for yes or no; a line for the homeowner to print his/her name, address, date and signature. A return address to the Association will also be printed on the ballot along with a return deadline date. A self-addressed return envelope for the homeowner’s use may also be included. For issues to be addressed at the annual board meeting, these ballots for any and all issues to be considered will be mailed two (2) weeks in advance. The returned ballots are to be tallied and recorded on a log sheet by the secretary-treasurer and the results announced.
