BOARD OF DIRECTORS MEETING MINUTES

Thursday, April 15, 2004

I. CALL TO ORDER

The April meeting of the Board of Directors of the Ryder Cup at Plum Creek Homeowners Association, Inc. was held on the evening of April 15, 2004 at the Phillip Miller Library, Wells Fargo Room, Castle Rock, CO. Board members present: Laura Cuddihy, David Guillen, Susan Redd, Marianne Rives, and Earl Wood. Representing management: Kim Maguire and Kelly Maguire with Premier Property Management, LLC. Homeowners present were: Shawn Strain, Ed Pickens, Helmi Pickens, Linda Mercer, Gay Shaffer, Helen Denike, Harold Moss, Cynthia Mannschreck, Don Colander, Gretchen Colander, Ron Redd, Mike Harris, Sam Baldridge, Nick Grove, Michele Grove.

II. ARCHITECTURAL GUIDELINES

Paul Bombalicky and Peter Reinhart (both representing Plum Creek North Masters Association) spoke of the architectural guidelines and expectations for backyards. Peter explained that three years ago they tried to set standards but have been giving time for new homeowners to get their backyards in place. They are now suggesting a September 2004 deadline. The standards are:
· 4 trees in back yard, 2 conifer and 2 deciduous
· Conifer trees should be at least 6’ tall
· Deciduous tress should have at least 1-1/2 inch caliper
(**Note: In the design guidelines, pg. 19, section O, paragraph 3 states 2-1/2” caliper – the 1-1/2 inch caliper statement was later acknowledged as being a verbal error.)
· Shrubs should be 5 gallons to start
· Continue with same style perimeter (rock or mulch) from front of house around to the back
· Sod rather than seed new grass
· Recommend putting in automatic irrigation system

Architectural committee must be consulted before making ANY change that can be seen from the exterior of your home. Design guidelines can be picked up for free on behalf of the Master’s from Premier Properties. Mr. Reinhart stated that the architectural committee would rather not be involved – leave it to Ryder Cup to handle. It was discussed that Ryder Cup could handle if submitted plans followed all of the guidelines, but send to Master’s if exceptions are to be made. Discussions began on whether Ryder Cup wants to take on this responsibility.

A homeowner expressed her opinion that if the Board is going to require homeowners to be in compliance by September 1 deadline, then the Board should have all fences stained and trees planted by September 1 as well.


III. ELECT BOARD OF DIRECTOR POSITIONS

Kelly Maguire led the election of officers.
· President
Earl Wood nominated Laura Cuddihy
Susan Redd nominated David Guillen
David won 3-2 with Earl and Laura dissenting.
· Secretary
Susan Redd nominated Marianne Rives
Laura Cuddihy nominated Earl Wood
Marianne won 4-1 with Laura dissenting.
· Treasurer
Marianne Rives nominated Susan Redd
Susan elected

IV. HOMEOWNERS FORUM

Homeowner’s forum began with David Guillen addressing the crowd. He vowed that everything the homeowners have to say would be addressed. No one’s issue will fall on deaf ears.
· Harold Moss brought up the issue of parking of trailers. Ron Redd addressed this by saying the town is currently defining their position on towing. Kim Maguire informed the board it will cost the board $800-$1000 for a legal opinion. Fining will have to be an issue addressed by the board. One homeowner asked if trailers are not enforceable, then what covenants are?
· Nick Grove asked about missing trees. The answer is the HOA took a settlement from US Homes instead of adding trees. Mr. Grove believes trees should still be HOA responsibility.
· Mike Harris thanked the board members for volunteering their time and complimented the newsletter.
· Linda Mercer asked if the allocation study is yet understood? At the last meeting it was said board would have understanding within two months.
· Cynthia Mannschreck voiced that she wants HOA to do trees this year as well as have back of her fence stained.
· Michele Grove questioned about replacing bad fence.

V. REVIEW OF ANNUAL MEETING MINUTES, MARCH 25, 2004

Susan Redd moved to table reviewing and approving minutes until next month. David Guillen seconded. Motion carried.

VI. REVIEW AND APPROVAL OF BOARD MEETING MINUTES, FEBRUARY 26, 2004

VII. REVIEW AND APPROVE FINANCIAL STATEMENTS

Susan Redd asked if Premier had called Urban Farmers about earlier bill. She requested they put inches of snow removed and question about the hand shoveling. She requested that no one sign checks without the inches removed written on there.

Cynthia Mannschreck asked about the $26,000 deficit that kept being referred to (number according to the reserve study). Kelly Maguire fielded that question.

Susan Redd moved to approve the financials. Laura Cuddihy seconded. Motion carried.

VIII. MANAGER’S REPORT

a. Review of Tree Proposal
Kim Maguire received a tree proposal and went over it. The board appreciated this and requested that she now get 3 proposals that contain prices for 6’ pine, 1-1/2” caliper deciduous, warrantee, tree removal, and tree planting. Kim was told that the Board would choose which trees would be replaced and all contracts must reference the HOA tree map.

b. Review of Violation Letters Sent to Homeowners
Violation letters were sent to 3 homeowners about removing parked trailers.

c. Reading Material, Design Review Guidelines

d. Reading Material, Newsline
Alternative High School coming to ‘old’ PS Miller Library building on Plum Creek Blvd.

e. Discussion of Water Plan and Update of Landscaping
Urban Farmer had to rewire all of the clocks this year. They will be at the next Board of Directors meeting. They will get a water plan to the Board.

IX. OLD BUSINESS

· The Reserve Study
Was targeted as crucial, and the Board would try to see what progress could be made via email discussion.

X. NEW BUSINESS

a. Discussion of West Nile
The HOA cannot force the golf course to fight West Nile. Ron Redd said the Town cannot currently force the golf course to treat for West Nile, but the Town has been asked to develop a resolution that would affect private property owners. Gay Shaffer suggested that the board get help from the Tri-County Health Department.

b. Discussion of Web Site
