Landlords, before leasing out your unit please be sure to read SPW Leasing Policy and follow all necessary steps in accordance with SPW bylaws to avoid later consequences.
It is very important that landlords must perform criminal history and background check on all potential residents. Please see at the end of this page for link to TX Department of Public Safety - Crime Records Service. All you need to do is to register and pay for $3 for each credit in order to obtain criminal history of a person (must have his name and birth date).
Upon a violation of this policy, the board of Directors could start fining the homeowner $50 for each violation each month until it is corrected.
The burden would not only fall on the homeowner but also for the Association and surrounding residents. For example, we recently have 2 sex-offenders who were allowed to become renters. Residents to include children are not safe living next door to these convicted sex-offenders.
Furthermore, uncreditworthy renters could leave homeowners in financial hole in a hurry. It would take several months for homeowner to evict non-paying renter. If maintenance fees are not paid during the process, homeowner could face foreclosure and lien imposed by the Association.
As mentioned above, statistics show that sex-offenders or convicted criminals would very likely to strike again. If a crime is committed on SPW complex, you as the homeowner, could face great liability and lawsuit. It is your sole responsibility to check for criminal history and creditworthiness of your potential renters.
