HOUSE BILL NO. 46

Feb 14, 2005

House Bill No. 46 would allow a neighborhood organization to take action against owners of nuisance property.

In any county... in any city ... (size specified), a parcel of property is a nuisance, if such property adversely affects the property values of a neighborhood because the owner of such property allows the property to be in deteriorated condition, due to neglect, violation of a code or standard, abandonment, failure to repair..."

The current law says that 'any property owner, who owns property within a reasonable distance to property alleged to be a nuisance may bring a nuisance action against the offending property owner...

Amended, it reads "A nuisance action for injunctive relief may be brought by a neighborhood organization" as defined by MO law to bring suit against the owner of a nuisance property.
