Summary of role of ACC
(Note: This information was distributed to the neighborhood by the 1999 ACC. Because so many new people now live in the neighborhood, I thought it would be helpful to republish it. All references to Articles and Sections are references to the original covenants. If you need a copy of the covenants, please contact a member of the ACC.)
Policy and Procedure of the Summer Walk ACC
Policy:
As a homeowner in Summer Walk and as a volunteer/appointed member of the ACC (Article VI Section 3) we desire to:
1) Educate each homeowner regarding the covenant standards of our community.
2) Provide all homeowners with clear steps for submitting requests for changes or additions to their property to the ACC.
3) Carry out the appointed duties to maintain and enforce the covenants of the community, for the benefit and protection of all homeowners of Summer Walk.
Procedure:
Submissions
The following are the procedures for all homeowners to follow when requesting permission from the ACC to perform changes, modifications, or additions of any kind to their property.
A. Contact a member of the ACC with questions and/or submissions.
B. All requests must be submitted in writing to the ACC. NO Oral submissions or approvals will be given or received by the ACC (Article VI Section 3.)
a. Approvals will be date stamped when received by the ACC. At such time, the 30-day deadline for a response begins.
C. Each request should include: (Article VI Section 3)
a. Homeowner?’s name, address, and phone number.
b. Date request was submitted.
c. Specifics of request with full detail disclosure (i.e. drawings, color, dimensions, location, materials, etc.)
D. The ACC?’s response to submitted requests will be as follows:
a. The ACC will meet and discuss all submitted requests an a decision of approved or not approved will be determined based on the covenants and guidelines set forth by the ACC.
b. If indicated, the ACC members will personally view/survey the property/area involved in the homeowner?’s request and will be aided by the submitted plans. The ACC will determine if a professional opinion is needed.
c. All requests must be approved or disapproved by the ACC. The homeowner must be notified of the decision in writing and/or in person. If the written response is not delivered to the homeowner in person by an ACC member, it will be sent via the U.S. postal service and must be post- marked within 30 days of the date of submission. (Article VI Section 3)
d. All decisions made by the ACC regarding a homeowner?’s request will be made by a majority vote by the ACC members.
e. All ACC members should be notified of requests and should be given the opportunity to vote.
f. All ACC decisions are final and binding. (Article VI Section 3)
g. Note: Unless specifically enumerated in the covenants, all ACC guidelines are exactly that ?– guidelines. Therefore, each request will be considered on an individual basis. All efforts will be made to treat all residents fairly.
Violations
The following are the procedures that will be carried out by the ACC when a homeowner?’s property is in violation of the covenants or ACC guidelines. (Article V Section 2, Article V Section 6, Article XII Sections 1,2,4)
A. The ACC member will speak to the homeowner in person or over the phone regarding the violation. The meeting or phone conversation must be recorded in the owner?’s file and must contain the following information:
a. Date and Time
b. Homeowner?’s name
c. ACC member(s) involved in the contact
d. Reason for the meeting
e. Written plan of action to resolve the violation ?– must include time agreed to correct violation
B. The above steps will be followed with a letter stating the above and sent via U.S. mail to the owner.
C. If for any reason the ACC member and Owner are unable to meet in person or converse about the matter after several attempts, the ACC will proceed by notifying the owner by First Class mail of the specifics of the violation(s) and what must be done to correct the violation(s). The homeowner will have 10 days after the receipt of such notice to correct the violation or at least begin the needed work. The homeowner should have a completion date within a reasonable amount of time (Article V Section 2). If the homeowner is unable to comply with the 10-day time constraint, the homeowner should contact the ACC for a possible time extension.
D. If the homeowner continues to remain in violation of the covenants or guidelines after the above steps, and if after 10 days the ACC has not been notified of the owner?’s plan to correct the violation(s), the ACC will:
a. Notify the Board of the steps taken to date.
b. Contact the homeowner in writing (via U.S. Certified mail). This documentation will include the following:
i. Recap the above steps and all actions taken to date.
ii. Restate the violation(s) and the step(s) needed to correct them.
iii. Notify the homeowner that the violation(s) must be corrected within 10 days. If the situation warrants, the ACC or Board may grant a longer period of time for corrections.
iv. If the homeowner does not comply within the stated time the Executive Board will, without further notice to the homeowner, hire the needed service(s) to correct the violation(s) and ALL expenses incurred will be the sole responsibility of the homeowner. (Article XII Section 1,2)

The ACC realizes that owning property is a very precious dream for all of us; therefore, the ACC?’s job to maintain and enforce the covenants and guidelines of the community exists for the benefit and protection of all homeowners in the Summer Walk neighborhood.
