Fort McDowell Mining Operation at 63rd Avenue & Jomax Road

No "Mining" While Rezoning

At the Board Of Adjustment Hearing, on 2/7/2002, the Fort McDowell Yavapai Mining Operation representative, Larray Lazarus, requested a 6-month extension to their landfill operations permit to pursue rezoning and sale of the parcel of land at 63rd Avenue, just north of Jomax Road. He also announced that they would agree to cease all activities related to the extraction of materials from the earth, to include blasting and digging during the 6 month extension. This agreement is in direct response to input received from homeowners in the adjacent housing communities. The next hearing to discuss possible land usage and possible adjustment to the 10-year extension is scheduled for the September Board Of Adjustments Meeting.

Notice is hereby given that the above request has been scheduled for hearing before the BOARD OF ADJUSTMENT on February 7, 2002, at 1:00 p.m., in City Council Chambers, 200 West Jefferson Street, Phoenix, Arizona.

Dear Neighbor:

For several years, the property Fort McDowell owns north of the northwest corner of 63"d Avenue and Jomax Road has been of concern to the homeowners in the area. Fort
McDowell with Councilman Siebert have been working towards a resolution to the concerns voiced.

Therefore, Fort McDowell has decided to rezone and attempt to sell the property to a developer. If the rezoning allows densities that make it economically feasible for a developer to purchase the property and develop it, the mining operation on the property will cease. Part of the rezoning process will be to determine how to utilize the property encumbered by the existing pit.

Therefore, Fort McDowell will be requesting a six (6) month continuance for the landfill operation time extension in order to concentrate working on rezoning the property for development and obtaining a purchaser for the property.
Cessation of the mining operation is one of the goals that Councilman Siebert has been working on since the property was annexed into the City. Fort McDowell desires to work with the neighbors to prepare a feasible rezoning plan for the property so that a developer can successfully purchase the property and have the mining in that area.
