Storm Drain Coverage

At the last annual meeting of the Home Owners Assoc. there was a speaker on Storm Drain Concerns. At the time, there was an expressed interest by the Board to pursue Delaware Countys' coverage of this issue. It could potentially add $60 - $100 to your annual tax bill. But, should a storm drain collapse, the property owner at the point of the collapse would be legally and financially liable for its' repair. That repair is estimated (dependent upon the circumstances) to be in the 10's of $1,000.00 of dollars. The home owner could sue all the contributing home owners to that section of the drain, but the individual would be liable, and the association would not assist that home owner in the dispute. Of course the expenses to sue would also be on the bill of the home owner, win or lose! Has anyone been advised of the status of this project by our elected officials? Are you ready for the Bill should a disaster occur?

Storm Drains?

We have a storm drain in our back yard. If it was to collapse, are we responsible for its repair under the current laws? If so, what is the chance that a collapse may happen? Also, how can I effect a change, if necessary, to excape from the responsiblility of caring for the repair of the drain system?
