Your HOA dollars at work.

Numerous times in the past year, your BOD, has spent your HOA dollars, threatening members, and in some cases, following through with legal action. This is the second time I have been threatened with legal action in the past year by our BOD, with our HOA dollars!

This time, Steve Bartlett using our money to pay the highly priced Gray & Becker to threaten me with a lawsuit. If Steve Bartlett, is concerned, with me telling you what I find out about him. Why doesn't he give all of us Full Disclosure?

I asked the BOD to give full disclosure months ago. They all refused. Why is Bartlett not hiring his own lawyer with his money, instead of spending your money to threaten me?

Remember the Gammon lawsuit? There would NOT have been a lawsuit if the BOD did not choose to put a cap on YOUR votes. Capping your votes (resident votes) in the election favored the developer (Bartlett), since builder votes would have not been reduced. The judge ruled the BOD was wrong, that the capping of votes was illegal. The $60,000-90,000 spent on Gray & Becker, was to cover the BOD trying to reduce your votes. Gammon was done with legal action, but they now sued him, for lawyer fees. The Judge said Gammon was right, the BOD is wasting more of your money. Gammon will never have to pay out since the judge said the election WAS illegal.

The BOD's lawsuit against Gammon, is now just an excuse for the BOD not to call meetings. That is what they are using your money for.

The secretary of State told me months ago, that an HOA, is like a mini government, that if the members see a problem, they need to vote the bad apples out.

Our HOA government is out of control.

Fiduciary responsibilities

If the Board had acted appropriately in managing their fiduciary responsibility to the CCHOA, the Board may not have determined the need to sue Gammon for legal expenses.

a. If you do the right thing, you are less likely to have a law suit filed; it may lessen your likelihood of suit.

b. If your actions are legal and appropriate, you may have insurance coverage.

c. If appropriate insurance had been procured by the CCHOA Board, the expenses could have been covered by the insurer.

c. If appropriate claims management had occurred by the CCHOA Board, there may not have been a need to spend CCHOA funds; expenses may have been covered by the insurer.

I say, BOD, pay up.

The new expanded Board needs to extract the legal costs from the three current Board of Directors personal monies, to recover the $80,000.00 or so spent on legal fees. Divide that amount into three.

The new board also needs to find a new attorney, since the woman lawyer we had on election night, misrepresented Mr. Gammon's lawsuit at the annual election. The current BOD were never clear about Mr. Gammon's case, only making him the scapegoat.

Where do they get off trying to reduce our votes, and spending our money to defend their crooked actions for self preservation?
