General Resolutions passed by the Board of Directors:

1.0 Title: Fines for infractions of the Covenants, Bylaws and Rules adopted by Board of Directors:
?“Be it resolved, that the Covenants, Restrictions and Rules Compliance Committee by a majority vote of those Members present or represented by proxy is hereby empowered to assess fines not to exceed $500.00 on any Lot Owner who fails to comply with the Covenants, Bylaws and Rules of the Association after being given proper notice. Proper notice shall consist of at least two letters posted by regular mail to the Lot Owner at the last known address in the Association?’s records warning that appropriate action must be taken to correct the deficiencies within the specified period of time not to exceed 30 days. It is the responsibility of any Lot Owner who may not occupy the premises to insure that any tenant or guest is notified of and abides by all Covenants, Bylaws and Rules because the Lot Owner will be the responsible party for any fines levied. The final letter must state that ?‘if the deficiencies are not corrected or the outstanding balance paid by the (specified date) a fine of a (specified amount) will be assessed and if the fine and outstanding balance, if applicable, is not paid within 45 days a lien for the amount of the fine and outstanding balance, if applicable, plus $258.00 to cover the costs of filing the lien will be placed on Lot (lot in question) ?‘?”.

2.0 Title: Storm Detention Ponds; Swimming Pool; Garage Sales:
?“Be it resolved, that neither human or animal swimming nor the use of any type of flotation device are allowed in the storm detention ponds. Be it further resolved, that the Club House and Pool Committee is authorized and empowered to adopt regulations for the use of the clubhouse, swimming pool and adjoining area. Be it further resolved, that an immediate fine not to exceed $500.00 can be assessed on any Lot Owner without prior written notice by the Covenants, Restrictions and Rules Compliance Committee if any attempt is made to hold a garage or similar type sale on any Lot, street or Common Area within the Village of Bailey Station.?”

3.0 Title: Fines for late payment of assessments:
?“Be it resolved, that the annual assessments provided for under Article VI, Section 2 of the Declaration of Covenants, Conditions and Restrictions for the Village of Bailey Station are due January 1st of each year, beginning January 1, 2001, and payable no later than February 15th or 30 days after the mailing date of the statement, whichever comes first. If the annual assessment has not been paid by March 1st a late fee of $25.00 will be assessed. If the annual assessment has not been paid by April 1st an additional late fee of $50.00 will be assessed. If the annual assessment has not been paid by May 1st a lien will be placed on the lot in question for the amount of the annual assessment plus late fees of $75.00 plus other costs of $258.00. Until January 1, 2001, assessments shall continue to be made on a monthly basis and if not paid by the end of the month of the assessment a late fee of $25.00 will be assessed and if not paid by the end of the next month an additional late fee of $25.00 will be assessed. If assessments for a period of three months become due and owing and are not paid by the end of such third month, a lien will be placed on the lot in question for the amount of the monthly assessments plus late fees of $100.00 plus other costs of $258.00.?”

4.0 Title: Making the President of the Association an Ex Officio Member of all committees:
?“Be it resolved, that the President of this Association shall be an Ex Officio Member of all committees of this Association with power to vote only in the event of a tie vote.?”

5.0 Title: Parking:
?“Be it resolved, that in accordance with Article IV. Section 1. (b) of the Declaration of Covenants, Conditions and Restrictions for the Village of Bailey Station and Article V. Section 3. (d) of the Bylaws of the Village of Bailey Station Homeowners Association, Inc., the following rules are hereby adopted for the protection of the Members and guests of the Village of Bailey Station.?”
1. No vehicle parking on the streets in the Village between the hours of Midnight and 8 A.M. Short term parking on the streets between the hours of 8 A.M. and Midnight should be minimized to allow unimpeded access for all emergency equipment and traffic. No parking on the curbs of the streets at any time.
2. To understand and explain the intent of Section 2, paragraphs (i) and (k) of Article VIII of the Declaration of Covenants, Conditions and Restrictions for the Village of Bailey Station, no recreational vehicles, commercial vehicles, trucks of any type, sports utility vehicles, trailers, boats, motorcycles, or any similar type vehicle shall be kept other than in the respective garages of the Members/Lot Owners.
3. Speed limit of 15 miles per hour on the private streets for the safety of everyone.
4. No 3 or 4 wheelers, dune buggies, go-carts, or similar type vehicles are to be driven on the streets.
5. Fines of up to $500.00 on any Lot Owner who fails to comply with these rules may be imposed by the Covenants, Restrictions and Rules Committee after the Lot Owner has been given proper notice. Proper notice shall consist of at least two letters posted by regular mail to the Lot Owner at the last known address in the Association?’s records warning that appropriate action must be taken to correct the deficiencies within the specified period of time not to exceed 30 days. The final letter must state that ?“if the deficiencies are not corrected by the (specified date) a fine of a (specified amount) will be assessed and if the fine is not paid within 45 days a lien for the amount of the fine plus $258.00 to cover the costs of filing the lien will be placed on Lot (lot in question).?”

6.0 Title: Empowering Committees:
?“Be it resolved, that the named committees of this Association, i.e.,

Finance and Budget Committee
1. Examine financial records of previous administration.
2. Review/audit financial records of the treasurer. Prepare budget after receiving input from other committees to reflect estimated annual income and expenses, including taxes on all Common Areas.
3. Set amount of annual assessment and determine payment schedules to be paid by the Owner of each Lot.
4. Working with the Treasurer, set up system for the collection of assessments and disbursement of funds of the Association with appropriate controls.
5. Working with the Secretary, set up system for maintaining up-to-date list of Lot Owners/residents.
6. Prepare annual financial statement, including the income and disbursements of the Association, and furnish to all Members within ninety (90) days from the date of the close of each fiscal year as required under Article IX. Section 3. of the Bylaws.

General Maintenance, Landscape, and Common Areas Committee
1. Carry out duties as set forth in Article V of the Declaration of Covenants.
2. Maintain roads, sewers, drainage,
sprinkler systems, and streetlights.
3. Solicit bids for the maintenance of the individual front, back and side yards on each Lot, all Common Areas to include mowing, edging, fertilizing, weed control, blowing, street and other clean-up; mulching and planting of Common Areas.
4. Solicit bids for garbage and recycle pickups.
5. Provide input for the Finance and Budget Committee.

Covenants, Restrictions and Rules Compliance Committee
1. Enforce the Rules adopted by the Board of Directors as provided for in Section VIII, Article 2.n. of the Declaration of Covenants and Article V, Section 3.d. of the Bylaws.
2. Enforce the Rules adopted by the Board and the Restrictive Covenants in the Declaration of Covenants, Conditions and Restrictions to specifically include restrictions as to garage sales; advertising signs; business activity; the screening required for all equipment, garbage cans, service yards, woodpiles or storage piles to conceal them from view of the private drives and street; no exterior antennas without prior approval of ACC; no recreational vehicles, commercial vehicles, trucks of any type, sports utility vehicles, trailers of any type, boats, motorcycles, or any similar type vehicle shall be kept other than in the respective garages of the Members/Lot Owners or otherwise screened from the view of neighbors or the streets; garage doors not to remain open for more than a reasonable time for vehicles entering or exiting the garage and reasonable periods for yard and residence maintenance; no fence to be built around the perimeter of any Lot or to enclose any Lot.
3. Regulate parking, motorized and non-motorized vehicular traffic. Recommend rules for adoption by the Board of Directors.

Architectural Control Committee
Carry out duties as set forth in Article VII of the Declaration of Covenants, Conditions and Restrictions. Obtain necessary record of actions of previous administration.



Nominating Committee
To be appointed by the Board of Directors prior to each annual meeting of the Members, to serve from the close of such annual meeting until the close of the next annual meeting, with such appointment to be announced at each annual meeting. The Chairman shall be a Member of the Board of Directors with two or more Members of the Association.

Security and Neighborhood Watch Committee
1. Work with local law enforcement authorities to establish a working neighborhood watch system for the Village. Promulgate to all Lot Owners.

Club House and Pool Committee
1. Solicit bids or provide the necessary structure for the upkeep and maintenance of the pool to ensure that it is maintained in accordance with required health department standards to provide a safe and sanitary environment for the pool, pool area and club house. Adopt regulations for the use of the clubhouse, swimming pool and adjoining area.
2. Provide reservation system for the use of the clubhouse by Members. Set fees, deposits, etc., if any, for use of these facilities.
3. Arrange for any necessary cleaning of the clubhouse with particular emphasis on the rest rooms and kitchen. Recommend changes to allow access to rest rooms during swimming season.
4. Provide input for the Finance and Budget Committee.

Advisory and Arbitration Committee
In the event of any dispute involving one or more Lot Owners and the Association that can not be resolved by the appropriate committee, then information about such dispute shall be submitted in writing by such Lot Owner(s) and the appropriate committee to this Arbitration Committee, which is to review all relevant information and provide a written report to the President of the Association for resolution of the dispute in accordance with the Declaration of Covenants, the Bylaws and other rules which may have been issued by the Board of Directors. It is not the intent of this committee to handle disputes between any Lot Owner and the builder/developer as to any construction problem concerning his/her/their individual unit. This Committee shall also advise the Board on any legal matters, and draft any legal opinions or documents necassary for the Board to protect the Association.

Welcoming and Hospitality Committee
1. Welcome new residents of the Village and provide them with information about the Association.
2. Coordinate information from all committees and members for a Quarterly Newsletter.
3. Arrange for social gatherings several times a year to be held in the clubhouse.

Insurance Committee
1. Review insurance needs of the Association to ensure that all types of casualty, personal liability, fidelity and any other type of insurance required or deemed necessary is in place to cover all the real and personal property of the Association and its Officers, Directors and others responsible for the assets of the Association.
2. Receive a certificate of insurance from each individual Lot Owner on an annual basis showing that the Owner is carrying blanket all-risk casualty insurance on the Lot and structures constructed thereon for full replacement cost as required under Article X, Section 2 of the Declaration of Covenants.
3. Provide input for the Finance and Budget Committee.

are hereby empowered with the respective duties and responsibilities as shown in this resolution and given the authority of this Board of Directors to enforce the Declaration of Covenants, Conditions and Restrictions for the Village of Bailey Station, the Bylaws of the Village of Bailey Station Homeowners Association, Inc., and the Rules adopted by this Board, as they may apply to the responsibilities of their committee, including the right to assess fines provided under General Resolutions 1.0, 2.0, 3.0 and 5.0.?”
