City of Fort Worth owns the Parkway not homeowners

May 23, 2009

SBB Managment sent out letters asking homeowners to remove signs from the property. Okay...However, Parkways are not private property, according to the City of Fort Worth and State of Texas.

Fort Worth says :Parkway (area between the street curb and front property line)

Public right-of-way means the entirety of any PUBLIC STREET area, including the public roadway and adjacent pedestrian ways and SHALL INCLUDE, but not be limited to, roadways, PARKWAYS, alleys and sidewalks.

Parkway means the area between the sidewalk and the curb of any street and where there is not sidewalk, the area between the edges of the roadway the property line adjacent to the roadway. Parkway shall also include any area within a roadway that is not open to vehicular traffic.

It shall be unlawful for any person to store or allow the storage of a motor vehicle upon the public streets, alleys, sidewalks or parkways of the city.

Michelle,

I question the board's authority in this matter to restrict the city from planting trees in city-owned property, particularly since the ***city retains ownership*** of the trees.

Thanks.

Or a letter from City of Fort Worth dated 9-14-05 stating the area between sidewalk and curb are the property of the City of Fort Worth.

Appears either inept, incompetence or attempts to supercede City of Fort Worth
