All owners shall receive and keep for reference, a copy of these Rules and Regulations. It is the owner(s) responsibility to make sure that these Rules and Regulations are obeyed by all guests, and/or renters. Owner(s) can be held responsible for any damage to common grounds by renters and/or guests. Additional copies of this document may be obtained from Tillett Property Management or successor.
The Board of Directors has the authority to adopt and amend reasonable rules and regulations concerning the use of the Association Property. The Board also has the right to enforce such rules. If an owner feels any rule or regulation is discriminatory or unfair for the good of the majority, they should contact the Board of Directors with a recommended change.
When we purchased property in this Association, we gave up certain individual rights we would have had if we had purchased a private home elsewhere. The purpose of the Rules and Regulations is to protect everyone's right to enjoy the community equally without interfering with others right to enjoy the same.
GENERAL RULES
1. Within 30 days of taking title, if the property will be rented, the Homeowners shall report to the Management Company the names of all other residents as well as an address and phone number to contact the Homeowner in case of emergency.
2. Arizona Law states that an Association can take action against in-home businesses, if the traffic to the neighborhood is increased. No owners, resident or guest may use the unit for any commercial purpose, including the performance of a service, the storage and/or dispensing of products or merchandise for sale at Villas at Royal Palms or elsewhere, or the reception of clients or customers which increases the normal traffic flow on the property.
3. The common areas may not be used for the storage of privately owned property including hoses or bicycles.
4. Changes to locks on doors and mailboxes are the homeowners responsibility.
5. No item may be hung on or over the walls, fences or balconies such that the items may be viewed from the common area, adjoining property, or the street, with exception to potted plants, holiday d?©cor in season and United States flags hung with proper flag etiquette (staff mountings require board approval).
6. Advertising signs, billboards, political signs, etc., are not permitted. One ?“For Rent?” or ?“For Sale?” sign not more than 4 feet square is allowed per unit, with the exception of additional signage for one-day open house events.
7. One ?“No Soliciting?” sign of a standard size may be placed at the front entrance of the unit.
POOL AND SPA
1. The pool facilities are for the use of owners, residents, tenants and guests only. Owners will be responsible for anyone to whom they provide pool access. Residents must accompany their guests at all times.
2. Gate must be locked at all times.
3. Children under the age of 14 must be accompanied and supervised by an adult (18 years or older) at all times when in the pool area.
4. No persons under the age of 18 are allowed in the pool area after 10pm.
5. Persons using portable radios in the pool area must maintain the volume at a level that cannot be heard beyond their immediate area.
6. Persons using rubber rafts or other floatation devices shall not interfere with others who wish to swim.
7. Infants or young children must wear rubberized pants or swim diapers while in the pool.
8. No pets allowed in the pool area. Damage caused by pet hair clogging equipment will be charged back to responsible owner.
9. No glass bottles or glassware of any kind is allowed in the pool area.
10. No running, yelling, horseplay, jumping, diving or obscene language is allowed in the pool area.
11. No skateboards, bicycles, etc., or sports equipment (other than swimming gear) is permitted in the pool area.
12. Swim at your own risk- No lifeguard is on duty.
13. Climbing on the fence, cabana, etc. is prohibited. Anyone damaging the pool facility or equipment will be responsible for repair or replacement.
14. Leave the pool area in a clean, neat and orderly condition.
15. All persons shall obey all posted pool signs.
16. Noise shall be kept at a considerate level.
17. Oils and lotions are prohibited. Only water-proof sun blocks should be used in the pool.
18. Swimsuits must be worn at all times.
PETS
1. Only domestic pets are allowed at Villas at Royal Palms. No other animals or livestock may be kept.
2. There is a leash law in effect (Mesa City Ordinance, Title 6, Chapter 4, Section 7) that states when outside of a unit, dogs should be kept on a leash no more than 6 feet in length and under the direct control of a responsible individual.
3. Pets are not permitted to run loose in or on the common areas. The owner of the unit and the owner of the pet shall be responsible for all damage to persons or property caused by the pet.
4. Pet owners are required at all times to monitor the activities of their pets so that such pets do not create a disturbance or constitute a nuisance to neighboring residents.
5. Droppings must be picked up immediately.
6. All owners, residents, tenants, and guests shall not be abusive to pets.
7. Any animal causing or creating a nuisance, disturbance or health hazard will result in a fine for the owner.
VEHICLES AND PARKING
1. No vehicle shall be parked in non-designated parking spaces. This includes all fire lanes, curbs, and in front of garages. No exception, even if lot is full.
2. No vehicle should park in a handicap parking area without the appropriate displays or license.
3. No vehicles may be stored or parked in any common area. No mobile homes, motor home, camper truck, boat, tent or similar vehicle shall be parked, stored, maintained, constructed, or reconstructed on any portion of the property or common areas.
4. Major vehicle repairs of any kind are strictly prohibited unless it is an emergency situation, i.e. car will not start or tire repair.
5. Recreation vehicles, campers, trailers, boats, large commercial vehicles and the like are not to be stored except in an owner?’s garage.
6. It is the owners responsibility to maintain all vehicles so they do not severely leak oils or fluids since they will damage the parking surface.
7. Trailers, campers, vans, trucks, motor homes, boats or similar vehicles are allowed on the property for a minimum amount of time for loading and unloading purposes.
8. All vehicles must have current registration and be in use otherwise must be stored in owner?’s garage.
9. The speed limit within the complex is 5 miles per hour. Homeowners can be fined for excessive speeds.
10. In the event an owner or renter chooses to ignore any of these rules and regulations, the Board may choose to tow away any vehicles in violation (24 hours after notice) at the owner?’s expense.
STORAGE/TRASH
1. All trash, garbage and rubbish of a unit shall be placed in the trash dumpsters. Non-compliance will result in a fine to the homeowner.
2. Residents that want to throw away large items must make their own arrangements for special pick-ups and may not place any trash outside of the trash receptacles.
3. No rubbish, trash or garbage nor containers for the unit shall be permitted to be kept outside of any unit.
4. All equipment of any kind, storage piles or cabinets, trunks, toolboxes, utility trailers or any other items of a similar nature shall not be kept outside.
5. No hazardous materials shall be disposed of in the dumpsters or anywhere on the property.
ARCHITECTURAL CONTROL AND LANDSCAPING
1. Pursuant to Article V of the CC & R?’s, homeowners and residents are not permitted to make any alterations in the structure or appearance of any unit or association property, unless authorized in writing by the Board of Directors.
2. Any owner wishing to alter or improve anything structurally outside the unit must make their initial written request to Tillett Property Management/Board prior to the work being done, showing the nature, kind, shape, height, materials and other attributes of the alteration.
3. Alterations include painting, addition of lights, awnings, security doors or windows, roofing materials, plants, shrubs, trees or anything that changes the appearance of the home exterior.
4. Note: The Board, in making its decision, will be guided by a number of criteria, including the harmony of design and location in relation to surrounding structures and topography.
5. Each owner is responsible for maintaining the exterior of his own home. This includes all doors, gates, screens, windows and window gratings among other items.
6. No owner, resident or guest shall remove, alter, injure or interfere in any way, with any shrubs, trees, grass, plantings or ground coverings on common property without first obtaining the written consent of the Architectural Committee. The owner, resident or guest will be charged for full replacement cost if their acts result in destruction (requiring repair) or killing of said shrubs, trees, grass, plantings or ground coverings
DELINQUENT ACCOUNTS
1. Association fees shall be due on the first day of each month.
2. A $25 bank return fee shall be charged for all checks that are returned for non-sufficient funds.
3. The account shall be considered delinquent if the full payment has not been received by the 30th day of each month.
4. Accounts that are delinquent for the first month shall be charged a $15 late fee.
5. Accounts that are delinquent for two consecutive months shall be charged an additional $15 late fee.
6. Accounts that are delinquent for three consecutive months shall be charged an additional $15 late fee, turned over to an attorney for collection, and a lien placed against the title of the homeowner?’s condominium.
7. The homeowner shall be responsible for all costs incurred in collecting unpaid account balances, including liens, filing fees, process server fees, and reasonable attorney?’s fees.
VIOLATIONS OF RULES AND REGULATIONS
1. Tillett Property Management shall send the owner of the property a letter detailing the violation and ask for the problem to stop or be resolved.
2. If the violation still exists after 30 days, the homeowner will be fined a minimum of $25.
3. The Board reserves the right to impose a fine without warning.
4. Fines will be porportionate to the violation. Fines will range from $25 - $1,000 depending on the violation.
5. If fines remain unpaid, at 90 days delinquent a lien will be filed on that Unit. Continued non-payment could result in a foreclosure.
6. Any fees paid by the Association for non compliance will be reimbursed to the Association by the Homeowner.
7. Replacement keys will be charged at a rate of $5.00 per key.
8. Replacement gate openers will be $50 each.
